Goals of EPCRA • To increase public knowledge of and access to information on the presence of chemicals in communities & releases of chemicals into the environment. • To encourage and support planning for response to environmental emergencies. What is Tier II (Section 311/312) Reporting? • The reporting of hazardous chemicals and extremely hazardous substances (EHS) stored at a facility. • Based on the maximum quantity on site at any one time. • Reporting is done on the Kansas Tier II online system. • Tier II Reports are sent to 3 places: – Kansas Department of Health & Environment – Local Emergency Planning Committee (LEPC) – Local Fire Department Our Mission: To protect and improve the health and environment of all Kansans.

Background: KDHE RTK Program Ten Staff were dedicated to these Late 1980’s – functions in support -Program Management of the KDHE Right-To- -Administration Know Program -Compliance and Enforcement -IT /Computer Support -Data Entry Our Mission: To protect and improve the health and environment of all Kansans.

  9. Kansas Tier II Database Development • Program first set up to enter all by hand • Graduated to a desktop software on diskette • Moved up to a web-based system – private contractor developed and maintained Our Mission: To protect and improve the health and environment of all Kansans.

Kansas Tier II Data • Over 20,000 facilities reporting annually under EPCRA in Kansas • Approximately 80% of the facilities are oil and gas production facilities • Can be accessed by 5 different user levels – Business – County – Region – Agency – Admin Our Mission: To protect and improve the health and environment of all Kansans.

New Funds to Enhance the Program • Add a second staff member • Assist regulated community (facilities) with compliance (one-stop Tier II filing) • Assist end users with accessing the data quickly and easily • Provide Tier II data to end users/responders in a format that works easily for each organization • Be able to integrate Tier II reports with other planning and response data • Provide current/updated Tier II data on a regular basis • Audits and Inspections to ensure facilities are correctly reporting the data Our Mission: To protect and improve the health and environment of all Kansans.

Oklahoma’s 1-Stop Shopping for Tier II data Oklahoma has signed MOA’s with their LEPCs: • The facilities only have to report the Tier II data to one place – the state. • The state provides the data to the LEPC’s on a quarterly basis. • The LEPC’s have committed to deliver the Tier II data to their Fire Services and others. • Each LEPC in Oklahoma receives $1,000.00 each year from the state of Oklahoma as part of this MOA.
