Background ● Superintendent’s Advisory Committee on Project Labor Agreements (PLA) held series of public forum meetings ○ June 4, 2019, June 20, 2019 and August 15, 2019 ● Board vote held on Sept 12, 2019 to direct staff to begin negotiations for a Project Labor Agreement ● Series of negotiation sessions occurred between the District and the Building Trades beginning on Dec 12, 2019 through May 8, 2020 ○ District Team consisted of Superintendent, Assistant Superintendent of Business Services and two board member liaisons-Martha Alvarado and Cipriano Vargas ● Final version of the Project Labor Agreement and Side Letter presented to board on July 23, 2020 3

Key Components of a PLA ● Guarantee of Labor Harmony ○ No strikes / No Lockouts Disputes Resolved by Grievance / Arbitration Mechanism ● Qualified Skilled Workers ○ Reduce Risk of Construction Delays Due to Worker Shortage ○ Encourage Safety ● Union Apprentice Programs ○ Pathway for Local Residents ● Local Hire Goals ○ 80% of Workers from San Diego County in Tier 1, 2 and 3 Zones ● Any Qualified Contractor May Bid ○ May Use Fringe Benefits if equal ● Encourage Local Small Business Participation ● Pre-Job Conference ○ Avoid Jobsite Disputes 4

Project List and Scope of PLA ● Duration of the Agreement ○ Effective from the date of the first contract award of any project included within the PLA ● Defined Project List (Phase 1) ○ Rancho Minerva-Landscaping and shade improvements ○ Lake/Madison-Pedestrian Access Pathway ○ VIDA Sewer Improvement Project ○ Vista Magnet Middle Front Entrance Project ● Side Letter to Reopen to Add Projects and Evaluate Local Hire Achievements after 2 years from the date of the first contract award under the PLA agreement ● Cost Control – Escape Clause ○ Must have Three (3) Responsible Bidders and Lowest Responsible and Responsive Bid cannot exceed 10% of Estimate ○ Result – May Rebid with or without PLA ● Provide Medical, Pension and Vacation Benefits to Workers 5

Benefits of the PLA ● Work Opportunity Program ○ Include Pre-Apprentice Programs ● Local Hire Goals – 80% Workers** ○ Tier 1 Residents – District Zip Codes (25% of Tier 2), Veterans and VUSD Graduates ○ Tier 2 Residents – North of Highway 52 Zip Codes (25% of Tier 3) ○ Tier 3 Residents – San Diego County Zip Codes (80%) **For every 100 workers, 80 will be local workers (within San Diego county). Of the 80 local workers, Five (5) will be from District zip codes and 20 will be from North of Highway 52 6

Next Steps ● Staff Recommendation to Approve the Project Labor Agreement and Side Letter ● If approved, District will need to engage a Project Labor Coordinator ○ Purchasing to develop RFP (request for proposal) ○ Approximate Timeline for Selection Process between 60 and 90 days to complete the selection process 7
