Response 24 March – New Permitted Development Right which enables restaurants, cafes and pubs to provide food takeaway and delivery service beyond which would be considered ancillary. Temporary right for 12 months only. 4 April – New regulations allowing local authorities to hold virtual planning committees. Apply to meetings up to 7 May 2021. 9 April – Permitted Development Right giving local authorities and health service bodies wide-ranging rights to change the use of sites to respond to pandemic. Until 31 December 2020. 14 May – Changes to Development Management Procedure Order to provide greater flexibility for local authorities to use other electronic methods to publicise planning applications. Until 31 December 2020. Two Written Ministerial Statements on 13 May in relation to extending construction hours and virtual planning measures.
Recovery Business and Planning Bill • Outdoor dining – a more streamlined route for businesses to secure a license to place furniture on the highway. Capped fee. Reduced consultation period. • Extension of construction hours – Fast track route for developers to apply for changes to planning restrictions to extend hours up to 9pm mon-sat. Until 1 April 2021. Does not apply to construction work on individual houses. • Extension of planning permissions – Extensions to 1 May 2021. - Automatic for unimplemented permissions between coming into force of measures and 31 December 2020. - Unimplemented permissions between 23 March and coming into force of measures, subject to ‘Additional Environmental Approval’. • Permanent measures to allow Planning Inspectorate to use more than one procedure type for a planning appeal. Amendment to CIL Regulations to allow charging authorities to defer CIL payments for small and medium sized developers for up to 6 months. Regulations laid on 30 June and will come into force in the summer.
Reform Additional Permitted Development Rights allowing for the upward extension of free-standing buildings, and the rebuilding of vacant and redundant buildings to create new homes. Reforms to the Use Class Order to support high street revival by allowing empty commercial buildings to be quickly repurposed. Planning Policy Paper setting out a plan for comprehensive reform of planning system. • The Government is committed to modernising the planning system, ensuring it supports the delivery of more high quality well designed homes that local people need, and creates more beautiful and greener communities. • The Government will bring forward proposals in the summer, and we will want to hear views from a range of voices on these reforms so that we can deliver on our ambition for a better planning system.
