  3. FAST Act • Signed into law on December 4, 2015 • Provides 5 years of funding certainty for infrastructure planning and investment • Authorizes $305 B (all modes) over FY 2016- 2020 ($226 B thru FHWA) • Continued focus on accelerating project delivery

Compliance Assessment Program (CAP) Reviews • Review for federal compliance • Random sample, state- & local-let – +/- 60 projects per year, statistically valid sample • 3 year cycle (focus on local-let in Year 3) • Few issues of non-compliance • Several opportunities to improve documentation and reduce risk

Steps to Ensure Compliance • Use LPA bid document template • Use electronic project files • Perform & document bid analysis • Verifications at beginning & throughout project – Prime performing at least 30% (or local minimum > 30%) – DBE goal attainment – Initial check for excluded parties (SAM.gov) • Best practice: Run the sub list through SAM.gov too!

  6. Steps to Ensure Compliance (cont.) • Properly record change orders • Communicate DBE substitutions • Use a system to track testing & material acceptance • Document process & payment of stockpiled materials

  9. Safety • Work Zone Safety – 2015: 6,000 WZ crashes in Ohio • 188 serious injuries, 30 fatalities – Look for ways to reduce hazards (attachment) – The public is paying for a work zone that meets specification

  10. Non-Discrimination • April 2015 conciliation agreement • ODOT increasing outreach & training • Proposal note 13 (DBE) – ODOT-let projects in 2015, local-let starting Oct. 1, 2016 • All projects now considered for DBE goal • Monitoring sub-recipient non-discrimination assurances • ODOT will collect & analyze data to monitor compliance

  11. ADA Transition Plans • Required of all public agencies – 50 or more employees (published plans) – Americans with Disabilities Act (1990) – Section 504 (1973) • Outreach & LTAP training

E-Construction • Construction administration – Secure, paperless process – Submittals, approvals, inspections, etc. – Efficient, saves time & money • ODOT & FHWA evaluating platforms – +100 mobile devices in all districts (EDC & OH $) – Pickaway County Eng’r piloting use of ODOT SiteManager for local-let project to test viability
