SGMA Back ckground • SGMA is a package of three bills (AB 1739, SB 1168, SB 1319) • Local control is a hallmark of SGMA • Sustainability must be achieved within 20 years • Requirement to manage groundwater under a Groundwater Sustainability Defined Sustainability Plan (GSP) The management and use of • 127 groundwater basins statewide groundwater in a manner that can must comply be maintained during the planning and implementation horizon (50 years) without causing undesirable results. 3

SGMA Back ckground Gro roundwater Su Sustain inabili lity Agen ency (G (GSA) Eligib ligibili lity • Any agency with water supply, water management or land use responsibilities • Single local public agency or combination of local agencies can form a GSA using a Joint Powers Agreement (JPA) or other legal agreement • Only public agencies can become or form a GSA but other stakeholders can participate through a legal agreement with participating agencies. • GSA(s) must develop and implement a GSP to meet the locally defined sustainability goal and to engage stakeholders. 7

Wyandotte Creek Subbasin Governance Proposal Agen ency Purp rpose • Create a new agency through a Joint Powers Authority (JPA) • The JPA would become the exclusive, single GSA for the entire Wyandotte Creek subbasin • The purpose of the JPA is to develop, adopt, and implement a GSP for the Basin and to involve the public and area stakeholders in developing and implementing the GSP 14

Wyandotte Creek Subbasin Governance Proposal Agri ricultural l St Stakeholder er Bo Board rd Mem ember Eligib ligibilit ity • One agricultural stakeholder seat and one alternate • Must own or lease property in active commercial agricultural operation overlying the subbasin OR be an employee of a commercial agricultural operation overlying the subbasin • Cannot be party to any pending litigation against the JPA or any of its member public agencies (Butte County, City of Oroville, Thermalito Water and Sewer District) 17

Wyandotte Creek Subbasin Governance Proposal Do Domestic Well ell User er St Stakeh ehold lder Bo Board Mem ember Eligib ligibili lity • One domestic well user stakeholder seat and one alternate • Own or lease residential property overlying the subbasin that is the stakeholder’s primary residence • Must extract groundwater from the subbasin for domestic use 18

Wyandotte Creek Subbasin Governance Proposal Appointment & Rem emoval of f St Stakeholder er Bo Board rd Mem embers • Stakeholder Board Members and alternates will be appointed by the JPA Board through an open application process • Stakeholder Board Members may only be removed from the JPA Board of Directors if they fail to attend three consecutive meetings or no longer meet the criteria 19

Example topics: • GSP adoption or modification • Assessment, charges, fees • Regulations or ordinances • Adoption of annual budget • Selection or removal of Advisory Committee members • Others, as stipulated in legal agreement 20

Wyandotte Creek Subbasin Governance Proposal Management Committee • The JPA will not have any employees • Each public agency who is a member of the JPA will appoint at least one staff member to a management committee • Receives direction from the JPA Board • Generates staff reports and proposals for the JPA Board’s consideration • Staffs the stakeholder advisory committee • Assures staff and other necessary resources are provided to prepare and implement the GSP 24

Wyandotte Creek Subbasin Governance Proposal Management Are reas • Management Areas refer to an area within a basin for which a GSP may identify different objectives, monitoring, and projects based on unique local conditions. • There will be two Management Areas in the Wyandotte Creek subbasin: • Management Area 1: non-agricultural areas within and directly adjacent to the City of Oroville • Management Area 2: The rural areas within the subbasin 25

Wyandotte Creek Subbasin Governance Proposal Management Are rea Chapters • The Management Areas would have distinct “chapters” in the GSP establishing different minimum thresholds, measurable objectives, monitoring, and projects, etc. • All “chapters” must be consistent with the basin -wide sustainability goals 26
