What does it mean to be a Volunteer? Legal Status Volunteer or Employee?
Contract of Employment Mutual Obligations Set working hours Perks
Employment Rights Guaranteed Payments Protected Rights Discrimination Protection
Legal cases Mid Sussex CAB “Volunteer” claimed disability discrimination when they were asked to no longer be a volunteer, saying this was due to their HIV status. LOCOG Female who suffered from severe epilepsy and arthritis, who volunteered and was accepted as a Games Maker by LOCOG, made an Employment Tribunal claim when she was unable to complete her duties and had to stop her volunteer work, stating that LOCOG failed to take sufficient account of her disability and make reasonable adjustments.
Reducing the Risks Clarify the Relationship Volunteer Agreement wording No employment status No additional “considerations” Only incurred expenses – nothing on top
Legitimate Expenses? Travel from Home Meals Equipment/clothing Childcare costs? Need to define in an expenses policy what is acceptable
Volunteer Handbook Background Expectations Communications Training required Expenses Policy Health & Safety Other Policies
