To The Secretary School Education, Government of the Punjab, Lahore. Subject: Presentation regarding writ petition No.26022/2010 Our submissions regarding the subject mentioned are as under: a. We have prayed the followings in our writ petition: i. Regularization w.e.f. the date of appointment (counting of contract period towards the pension, gratuity, leave, seniority etc.) ii. Pay protection along with entitlement of annual increment of 2009. iii. Grant of higher scale to all educators according to their academic q u a l i f i c a t i o n s . i . e . ESE/Pst(Bps#14),SESE/ESt(Bps#16),SSE/SST(Bps#17). b. It is an admitted fact that the government of the Punjab has been making amendments in different rules of its Establishment Codes (Civil Servants rules 1974, Civil servants rules (appointments and conditions) 1974, etc.) to provide interim reliefs to its civil servants. c. We are more than one lac in strength and demanding the interim relief of Regularization w.e.f the date of appointment (counting of contract period towards the pension, gratuity, leave etc.) by making amendments in Establishment codes or by relaxing the rules on the followings basis: i. Our contract service was governed by the School Education Department Government of the Punjab and was continuous without any gap up to the date of our regularization i.e. 19th October 2009. ii. There is nothing disputable regarding our seniority as we are willing to be placed at the bottom of all those teachers who were promoted before our date of contract appointment e.g. if in the year 2002 any batch of teachers belonging to any category was promoted in any month, all the educators are willing to forego their seniority and be placed at their bottom in 2002 and same procedure will be adopted for all educators appointed in 2000,2003,2004,2006. iii. If in any case the above said seniority criteria faces any hurdle then all the educators are willing to forego their seniority from the date of contract appointment and to be granted seniority from the date of award of pay scales i.e. 24 September 2007( same as graduate English teachers were granted ). iv. If in any case Department faces any hurdle regarding our seniority from 24 September 2007 then we are voluntarily foregone our seniority at all and accept the seniority criteria already issued by your department dated 30-08-2010. v. There is nothing disputable regarding counting of our contract service towards the pension,gratuity,leave etc. so our contract period kindly be counted towards the pension,gratuity,leave etc d. As far as our pay protection is concerned, we kindly be granted pay protection on the followings basis: i. Government of the Punjab has protected our pay from the date of contract appointment in its letter no. SO(SE-III)-2-16/2007 dated 24-09-2007 which states as under: “ The pay of an Educator will be fixed presumptively in the relevant pay scale on initial stage w.e.f. his date of appointment and then by adding periodical increments on notial basis upto 01.09.2007.The changes in the pay revision Rules from time to time will be kept in view while fixing his pay accordingly”. ii. Government of the Punjab has granted pay protection to all such lecturers who were appointed on contract basis in the year 2002 vide order no.S.O.(CE-III)Regular/2009 dated 13th August 2009 .We have the resemblance with this case so we too kindly be granted pay protection. iii. Government of the Punjab has granted pay protection to all such Specialist doctors who were appointed on contract basis vide order no. S.O. (SC)REC (BS-18)2009 issued in August 2009 . We have the resemblance with this case so we too kindly be granted pay protection. iv. Welfare Schools in the Punjab vide No.WW-Edu-II(S/O)/09-08 in August 2010 . Our case may kindly be treated in the same way. v. Government of the Punjab has granted pay protection to Drug Inspectors/Hospital Pharmacists etc through the advice of Finance Department vide U.O.No.FD.SR.II/9-16/2007,dated 10.08.2007. Our case may kindly be treated in the same way. vi. In response to Finance Department’s U.O.No.FD.SR.II/9-159/09,dated 27-04-2010 ,Services and General Administration Department Punjab admits our pay protection and advises to the Secretary Finance Punjab in the letter dated 24-05-2010 as: “The provision of Contract Appointment Policy-2004 also provides that in case a contract employee gets appointment against another post on regular basis and in case of regular employee of the Punjab Government, who gets appointment on contract basis, the benefit of pay protection is admissible. Moreover, in case an adhoc employee is appointed on regular basis (without any gap), the pay protection is admissible. After appointment on regular basis w.e.f.14-10-2009, the employees have become Civil Servants and provisions of Punjab Civil Servants Act, 1974 and Rules framed there under, are applicable in their cases”. vii. As rate of dearness is increasing day by day and it is very much difficult for all educators to manage and meet their family expenses with such a salary because without pay protection every educator has been facing a loss of at least Rs.3000 per month. The chart attached can show the loss being faced by educators without pay protection so we demanded our pay protection on human rights basis to meet our family expenses and be a prosperous citizen of Pakistan. e. As far as our demand for grant of higher scale is concerned, the educators belonging to category ESE/Pst were appointed on graduation basis in primary schools in Bps#9 while Government of Punjab appointed Graduate English teachers in primary schools in Bps#14, later on being regularized they have been further upgraded to Bps#15 and Bps#16 according to their qualifications therefore being a civil servants of Punjab we are to be upgraded in the same way and be awarded higher scales accordingly. Similarly other two categories of SESE/Est and SSE/SST be treated in the same way. All SESEs/Ests qualify the basic qualification of Bs#16 and all SSEs/SSTs qualify the basic qualification of Bs#17 so they all be granted the pay scales according to their qualification.
