This Is A Stream If It Has: • A channel between defined banks and at least 2 of the following: – Has a scoured mineral bed – Flows at least 6 months/year – Mapped on a U.S.G.S. topo map as a solid or dashed blue line – Contains fish, aquatic animals or aquatic vegetation – Is devoid of upland vegetation MAINE DEPARTMENT OF ENVIRONMENTAL PROTECTION www.maine.gov/dep
Culvert Replacement Exempt from permitting if: • Erosion controls are used • Does not block fish passage • Installed to match natural grade to avoid drops or perching • Embedded in stream a minimum of 1 foot or 25% Diameter (max 2 feet) MAINE DEPARTMENT OF ENVIRONMENTAL PROTECTION www.maine.gov/dep
Permit By Rule (PBR) • Fast and easy permitting process • For a project to qualify for Permit-by-Rule, it must be designed and constructed in compliance with all applicable Chapter 305 Rules • Chapter 305 Section 10 covers stream crossings (bridges, culverts, fords) MAINE DEPARTMENT OF ENVIRONMENTAL PROTECTION www.maine.gov/dep
Stream Crossings • Fill slopes must be stabilized • 3 times the cross sectional area of the stream channel OR accommodate 25-year storm • Surface water must be diverted through vegetated buffer areas of at least 25’ • If working in less than 3’ of water, must divert water around work area MAINE DEPARTMENT OF ENVIRONMENTAL PROTECTION www.maine.gov/dep
