KEY HIGHLIGHTS OF LEGISLATION • Part 3 of Children and Families Act 2014 and Code of Practice (statutory guidance) • Applies to children with special educational needs and those with a disability with link to Equality Act 2010 • S EN S upport replaces school action/ action plus and early years action/ action plus • Broad areas of S EN amended; behaviour, emotional and social difficulties out and social, emotional and mental health difficulties in (focus on underlying causes of behaviour that may be challenging) • Graduated approach in education settings remains: assess, plan, do, review cycle

KEY HIGHLIGHTS OF LEGISLATION • Increased age range to 0 to 25 years • Reduced timescale for statutory assessment to 20 weeks • Focus on preparation for adulthood with links to Care Act 2014 and amendment to S ection 17 of Children Act 1989 • New j oint commissioning duty on CCG and LA • Academies, Free S chools, FE colleges have same S EN duties as schools and assumption in favour of mainstream education • Rights of appeal extended to age 25 including FE colleges and young people have rights of their own

LOCAL OFFER • Must set out in one place information about provision LA expects to be available across education, health and social care for CYP with S END • Two key purposes: • To provide clear, comprehensive and accessible information about the available provision and how to access it, and • To make provision more responsive to local needs and aspirational by directly involving disabled children and young people and those with S EN and their parents, and service providers in its development and review

  5. LOCAL OFFER • Core offer being drafted and information required about settings and services agreed • S pecification drawn up and design work underway • Platform to be agreed to link with wider council local offer • Web based tool designed to collect information • Consultation - extensive

EDUCATION, HEALTH & CARE ASSESSMENTS AND PLANS • Joint assessments; outcome focussed; based on person centred principles, ‘ key worker’ to support parents through process • Draft EHC Plan template approved • 20 week assessment process and conversion process approved • Phased implementation to commence (trial) • Professionals involved will be notified and provided with training • Must convert statements and LDAs to EHC plans within 3.5 and 2 years respectively

EDUCATION, HEALTH & CARE ASSESSMENTS AND PLANS • Guidance crit eria and process for making a request being developed linked t o early help and evidence of use of schools £6k • Annual review process being developed; will include social care where provision is made • Review in year 9 will focus on preparat ion for adult hood including housing, employment , leisure • Transit ion prot ocols being drawn up; t ransit ion forum set up; t ransit ion dat abase t o support commissioning • No more request s under current legislat ion from 1 S ept ember • Considering t he provision of support and IAG for families (dut y) • Draft specificat ion for mediat ion service (dut y)

PERSONAL BUDGETS • Duty to offer with EHC plan • Indicative personal budget – direct payments • Resource allocation process agreed with FACE (as AS C) • Direct payments will be offered for care/ respite, home to school transport and continuing health care subj ect to individual assessment and eligibility • Direct payments will be seamless with adult social care with use of pre-paid cards • Will consider extension to direct payments in future

  9. JOINT COMMISSIONING • Duty for CCG and LA • Partnerships across education, health and care, children, young people and families • Joint understanding e.g. JSNA • Joint Planning • Joint Delivery • Joint review to improve the service offer

  10. CHILDREN WITH MEDICAL CONDITIONS • New statutory duties on schools • S tatutory guidance April 2014 • Policy, named person and procedures • Individual healthcare plans • S taff training • Inclusion in school trips, sporting activities; similarity to Equality Act 2010 duty
