An Act to provide for the construction, repair and maintenance of public roads and highways through a special assessment process.
Landowner Approach 1. Landowners submit petition to KCRC requesting ◦ improvement with signatures of more than 51% of owners of lineal frontage of lands within district Township Approach 2. Township Board submits resolution to KCRC ◦ requesting improvement
Accept Resolution/Petition After determining proposed improvement necessary, make Declaration of Necessity Hold Public Hearing on Declaration of Necessity at Township Hall If no objection, KCRC obtains specifications, surveys, and cost estimates Make First Order of Determination Hold Public Hearing on Objections (establish SAD and assessments) Make Final Order of Determination KCRC proceeds to let contracts for project
Appoint a township contact person Assist KCRC in developing and certifying the road improvement petition ◦ Compare signatures with tax/ownership records ◦ All owners of each parcel must sign ◦ Deceased/divorced owners – document for file Assist KCRC in developing the proposed cost structure Assist KCRC in creating the special assessment district Develop the special assessment roll Develop the special assessment mailing list Issue county treasurer notice of assessments Field questions from landowners concerning project
The cost structure defines how the project will be paid for: ◦ Township At Large Contribution ( not required ) ◦ KCRC At Large Contribution (not required) ◦ Special Assessment of Landowners ◦ Other funding sources
