  7. Legislative Mandate Mandate of the NRCS is derived from the following Acts. National Regulator for Compulsory Specifications Act (Act No. 5 of 2008) Legal Metrology Act (Act No. 9 of 2014) National Building Regulations and Building Standards Act (Act No. 103 of 1977) The Foodstuffs, Cosmetics and Disinfectants Act (Act 54 of 1972) 7

Policy Mandate The mandate of the NRCS ,as an entity of the dti is informed by action plans and programmes set out by the government priorities The NRCS Strategy is aligned to the following strategic objectives of the dti : • Facilitate transformation of the economy to promote industrial development, investment, competitiveness and employment creation • Create a fair regulatory environment that enables investment, trade and enterprise development, in an equitable and socially responsible manner • Build mutually beneficial regional and global relations to advance South Africa’s trade, industrial policy and economic development objectives 9

NRCS Strategy and enablers • Strategy to focus on Source Inspections – Source is point of entry or manufacture – lock out non-compliant products before the products enter point of trade and ensure that NRCS is more efficient in regulating the market. – Retail and distributor inspections are meant for intelligence gathering and to identify non-compliant products and remove from the market. • Enablers – intelligent utilisation of information technology and effective supervision. – Collaboration with SARS, SABS, DAFF, NCC, DoH, SAPS, Home Affairs, – Effective risk profiling through SARS platform reducing delays at ports – Market Intelligence – Bill of lading, manifests 10

Food and Associated Industries - FAI • The Business Unit is the recognized competent authority for the regulation and control of various fish and fishery products, both nationally and internationally • The business unit regulate all locally produced and imported canned and frozen fishery products. • Including canned meat product

  12. AREA OF RESPONSIILITY Fishing Industry 80% Canned Meat Industry – 10 % Non- Compulsory Specification work – 10%

Fishing Industry 9 Provinces • South African coastline 3 623 km • Fishing industry has an estimated annual turnover of about R80 billion • and contributes +- 1.0 % to the gross domestic product (GDP). In addition is the minimal activity in Aquaculture Industry • Marine aquaculture sector • Fresh water aquaculture sector • 13

Fishing Industry • The industry consist of: • Demersal hake trawl fishery • Pelagic purse seine fishery for anchovy and sardine. • Midwater trawl fishery targeting horse mackerel • Large pelagic fishery – tuna , swordfish and shark • Rock lobster industry • Squid jigging industry • Wild Abalone 14

Marine Aquaculture Industry • Aqua-culture activities small and 2011 figures as follows : • Total production for main marine species total 1883 Metric tons : • Abalone -Haliotis midae which is 55% of total production • Oysters Crassostrea gigas which is 14.3% of total production • Mussels e.g.Mytilus galloprovincialis which is 25% of total production • Finfish Dusky cob and yellowtail which is 0.4% or 7.99 MT 16

  17. Fresh Water Aquaculture Industry Fresh Water Species: • Total production 2921 MT • Western Cape again highest production (1428 MT) Made up of : o Trout -Oncorhynchus mykiss and Salmo trutta o Tilapia- Oreochromis mossambicus o Catfish - Clarias gariepinus o some ornamental fish 17

Regional and International Involvement • WTO (TBT/SPS) regulatory model and approach (all regulations notified) • Technical requirements based on international standards • NRCS is directly involved with Codex Alimentarius specifically • Leads the Codex Committee for fish and fishery products • Actively participate in Codex Committee on Food Import and Export Inspection and Certification Systems • Actively participate in Regional Codex Coordinating Committee for Africa • Actively participate in Codex Alimentarius Commission 18

  19. Regional and International trade facilitation • NRCS as the Competent Authority for export of fishery products to various countries including : • European Union • China and Hong Kong • Brazil • Japan 19

Regional and International trade facilitation • Technical Cooperation Agreements • Cover harmonization of food regulations • Certification and inspection approaches • Exchange of technical and scientific information • Regional Technical Cooperation Agreements with • Namibia • Mozambique • Mauritius • Regional trade facilitation • All fish and fishery products exported with NRCS certificate to Botswana and Zambia are not subjected to further inspections in 20 these countries

Thailand Cooperation with South Africa • Thailand has a history of exporting Fish and Fishery products to South Africa (since 1990) • This agreement was signed between SABS/NRCS and Department of Fisheries (DOF) in 2001 • Currently the agreement has been renewed every five years • Regular meetings • Factory inspection for both Countries • Benchmarking of inspection systems • Legislative comparisons • Cooperation on training of inspectors

  23. Reduced Rate Inspection Agreement • Signed since 2010 • Applicable to the Canned Tuna and Frozen Fishery Products. • Establishments must be registered with DOF. • All products from these establishments must be accompanied by an Health guarantee from DOF to SA. • Direct market access • Every fifth consignment will be fully inspected be upon arrival in SA

  24. Canned fish regulations • All locally produced canned fishery products as well imported products, have to comply with the same requirements : NRCS Act • NRCS inspectors may visit foreign factories supplying product, to confirm compliance. • Co-operation with authorities in the supplying countries preferred • Good mutual cooperation exist between NRCS and DOF in terms of Technical Agreement.
