Today's goals • T o initiate an ongoing conversation with the tribal transit community: – How should FTA educate its staff on tribal sovereignty, its federal trust responsibilities, and government-to-government relationships? – How can FTA ensure that tribes serve as a first resource for advice and guidance as it develops government-to-government trainings for its staff? 9

DOT Goals and Initiatives DOT Order 5301.1 (1999): Lists goals for Modal Administrations to meet • when carrying out policies, programs, and activities affecting American Indians, Alaska Natives, and tribes, including – “Integrate information about Federal laws and policies on relations with American Indians and Alaska Natives into DOT training ” – “ Educate DOT employees on American Indian, Alaska Native and tribal laws, policies, programs, activities, culture, and traditions.” 11
DOT Goals and Initiatives USDOT Tribal Consultation Plan (2011): “affirms USDOT's commitment • to foster and facilitate positive government-to-government relations between the Department and all Federally-recognized Indian tribes” – “Foster meaningful government-to-government relations by… Seeking tribal government representation in meetings, conferences, summits, advisory committees, and review boards concerning issues with tribal implications” – “Ensure the USDOT’s uniform and effective delivery of tribal programs throughout the country by … • Developing training modules for USDOT employees on tribal transit and highway programs; • Developing a training program for USDOT employees regarding tribes, the sovereignty of tribal governments, and the unique government-to-government relationship between tribes and the Federal government; and • Enhancing support for tribal Liaisons in the Federal Transit Administration” 12

Goals of this Initiative (Proposed by FTA) Strengthen the G2G relationship between tribal governments and • FTA by: – Establishing meaningful understanding of tribal sovereignty – Raising awareness of unique and diverse tribal transit environments – Fostering sincere commitment to carry out FTA and USDOT’s trust responsibilities alongside broader organizational goals … within FTA leadership and staff across the organization • 14

Potential Approaches (Proposed by FTA) NEED: FTA regional staff who work directly with tribes need advanced understanding of tribal sovereignty, federal trust responsibility, and culturally-sensitive communication. FTA Headquarters could implement monthly G2G peer-to- IDEA: peer learning sessions for Tribal Liaisons in 2020. Tribes could advise FTA on curriculum and serve as special guests at sessions. FTA program managers and leadership need understanding of NEED: key concepts in tribal sovereignty and federal trust responsibilities. FTA could develop an introductory training module for IDEA: FTA staff through 2020. Tribes could advise FTA on curriculum and key learning objectives. 16
Discussion • How should FTA deliver government-to- government training to functional teams (program management, safety and oversight, budget and policy, grant administration, etc.) and/or staff (Regional, Headquarters, Executive Leadership, etc.)? 17
Ongoing Feedback (Proposed by FTA) IDEA: Form a Steering Committee Composed of tribal transit representatives to review training materials as they are developed. IDEA: Maintain engagement and awareness Through quarterly briefing and consultative webinars for tribes on the initiative, in partnership with National RTAP . IDEA: Public Workshops Held by FTA/National RTAP at tribal and/or rural transportation conferences throughout 2020 to showcase progress and gather ongoing guidance from tribes. 18
