10/29/2012 Transition Related Indicators Indicator 13: “ ….. There must also be evidence that the student was invited to the IEP team meeting where transition services are to be meeting where transition services are to be discussed and evidence that, if appropriate, a representative of any participating agency was invited to the IEP Team meeting with the prior consent of the parent or student who has reached the age of majority. ” g j y [20 U.S.C. 1416(a)(3)(B)] Consent to Invite an Agency • An IEP compliant in the area of evidence of consent to invite an agency will meet the consent to invite an agency will meet the following criteria: – Written consent must be obtained before inviting the agency to the IEP meeting. – An agency is required to be invited if the agency An agency is required to be invited if the agency is likely to provide or pay for transition services. 2
10/29/2012 Consent to Invite an Agency • If an adult agency will not provide or pay for a service the next year, you must include a description why that agency will not provide a service and indicate that this is the reason the agency was not invited to the meeting. • If a parent does not give consent to invite an agency, you cannot invite an agency. Denial of permission must be documented in the IEP, use form 440 for this documentation. • If a parent invites and brings an outside agency to the IEP meeting, use form 440 to document that the agency was invited by the parent. Evidence of Compliance • IEP file includes both parental consent and the agency invitation . • Both parental consent and agency invitation are dated. Both parental consent and agency invitation are dated. • Parental consent must be dated prior to the agency invitation. • Consent can be verbal consent (documented and dated) and signed on the day of the meeting (with documentation that prior verbal consent was given). • Invitation can be an email notice of meeting • Invitation can be an email, notice of meeting, documentation of a phone call, etc. 3
