• This ¡topic ¡will ¡trace ¡the ¡evolu4on ¡of ¡MSHA ¡Requests ¡for ¡ Informa4on. ¡ ¡ • Beginning ¡with ¡accident ¡inves4ga4ons ¡and ¡Part ¡50 ¡Audits, ¡ the ¡Agency ¡has ¡asserted ¡its ¡authority ¡to ¡review ¡records ¡ not ¡required ¡to ¡be ¡maintained ¡under ¡the ¡Mine ¡Act. ¡ • In ¡the ¡early ¡days, ¡most ¡li4ga4on ¡turned ¡on ¡whether ¡a ¡ record ¡was ¡required ¡to ¡be ¡kept ¡under ¡the ¡Mine ¡Act. ¡ ¡If ¡it ¡ was ¡not, ¡MSHA ¡could ¡not ¡get ¡access ¡to ¡the ¡records. ¡ ¡ ¡ ¡ ¡ ¡
• Some ¡may ¡recall ¡former ¡Commissioner ¡Duffy ¡who ¡gave ¡a ¡ presenta4on ¡in ¡one ¡of ¡our ¡earlier ¡programs ¡on ¡what ¡records ¡ had ¡to ¡be ¡kept ¡under ¡the ¡Act. ¡ ¡ • This ¡first ¡began ¡to ¡change ¡in ¡accident ¡inves4ga4ons ¡and ¡then ¡ carried ¡over ¡into ¡Part ¡50 ¡audits ¡and ¡110(c) ¡inves4ga4ons. ¡ ¡ • It ¡has ¡now ¡evolved ¡at ¡the ¡ALJ, ¡Commission ¡and ¡Courts ¡of ¡ Appeal ¡levels ¡to ¡give ¡MSHA ¡access ¡to ¡almost ¡all ¡records. ¡ ¡ ¡ ¡ ¡ ¡
• ALJs ¡and ¡the ¡Commission ¡have ¡increasingly ¡recognized ¡ MSHA’s ¡authority ¡to ¡request ¡informa4on. ¡ ¡ • Today ¡we ¡will ¡discuss ¡the ¡evolu4on ¡and ¡whether ¡we ¡are ¡ headed ¡towards ¡or ¡have ¡arrived ¡at ¡a ¡recogni4on ¡of ¡an ¡ administra4ve ¡subpoena. ¡ ¡ ¡ • The ¡three ¡of ¡us ¡will ¡cover: ¡ • Accident ¡inves4ga4ons ¡ • Part ¡50 ¡audits ¡ • 110(c) ¡inves4ga4ons ¡ • 105(c) ¡inves4ga4ons. ¡ ¡ ¡ ¡ ¡ ¡
Accident ¡inves+ga+ons….. ¡ U. ¡S. ¡Steel ¡Corp., ¡6 ¡FMSHRC ¡1423 ¡(June ¡1984) ¡ • Here, ¡the ¡Commission ¡considered ¡whether ¡an ¡operator ¡violated ¡sec4on ¡ 103(a) ¡by ¡restric4ng ¡access ¡to ¡an ¡accident ¡scene ¡and ¡insisted ¡on ¡the ¡presence ¡ of ¡corporate ¡counsel ¡during ¡an ¡inves4ga4ve ¡interview ¡of ¡one ¡of ¡its ¡foremen. ¡ ¡ ¡ • Commission ¡ruled ¡operator ¡violated ¡the ¡Act ¡and ¡denied ¡access ¡to ¡the ¡MSHA ¡ inves4gator ¡(who ¡was ¡at ¡the ¡mine ¡conduc4ng ¡a ¡regular ¡inspec4on). ¡ ¡It ¡further, ¡ held ¡§ ¡103(a) ¡conferred ¡MSHA ¡broad ¡authority ¡to ¡conduct ¡mine ¡inspec4ons. ¡ Id. ¡at ¡1430-‑31. ¡ ¡ • It ¡also ¡concluded ¡that ¡the ¡operator ¡violated ¡sec4on ¡103(a) ¡by ¡insis4ng ¡that ¡its ¡ aWorney ¡be ¡present ¡during ¡MSHA's ¡interview ¡of ¡a ¡foreman ¡pursuant ¡to ¡an ¡ accident ¡inves4ga4on, ¡and ¡then ¡failed ¡to ¡specify ¡when ¡he ¡or ¡she ¡would ¡be ¡ available. ¡The ¡Commission ¡held ¡that ¡this ¡impeded ¡the ¡accident ¡inves4ga4on ¡ in ¡viola4on ¡of ¡sec4on ¡103(a). ¡Id. ¡at ¡1433. ¡ ¡ ¡ ¡ ¡ ¡
Right ¡to ¡Informa_on ¡in ¡Accident ¡Inves_ga_ons ¡ ¡ ¡ and ¡Part ¡50 ¡Audits ¡ [T]he ¡Secretary…shall ¡make ¡frequent ¡inspec4ons ¡and ¡inves4ga4ons ¡in ¡coal…mines…for ¡the ¡ • purpose ¡of ¡(1) ¡obtaining, ¡u4lizing, ¡and ¡dissemina4ng ¡informa4on ¡rela4ng ¡to ¡health ¡and ¡safety ¡ condi4ons, ¡the ¡causes ¡of ¡accidents, ¡and ¡the ¡causes ¡of ¡diseases, ¡physical ¡impairments ¡origina4ng ¡ in ¡such ¡mines, ¡[and] ¡(2) ¡gathering ¡informa4on ¡with ¡respect ¡to ¡mandatory ¡health ¡or ¡safety ¡ standards… ¡ § ¡103(h) ¡Mine ¡Act ¡ ¡ • …every ¡operator ¡of ¡a ¡coal…mine ¡shall ¡establish ¡and ¡maintain ¡such ¡records, ¡make ¡such ¡reports, ¡ and ¡provide ¡such ¡informa4on ¡as ¡[MSHA] ¡may ¡reasonably ¡require ¡from ¡4me ¡to ¡4me ¡to ¡enable ¡ [MSHA] ¡to ¡perform ¡[its] ¡func4ons ¡[under ¡the ¡Mine ¡Act]…Except ¡to ¡the ¡extent ¡otherwise ¡ specifically ¡provided ¡by ¡this ¡Act, ¡all ¡records, ¡informa4on, ¡reports, ¡findings, ¡cita4ons, ¡no4ces, ¡ orders ¡or ¡decisions ¡required ¡or ¡issued…may ¡be ¡published ¡from ¡4me ¡to ¡4me, ¡may ¡be ¡released ¡to ¡ any ¡interested ¡person, ¡and ¡shall ¡be ¡made ¡available ¡for ¡public ¡inspec4on. ¡ ¡ ¡ § ¡103(h) ¡Mine ¡Act ¡ ¡ • Upon ¡request ¡by ¡MSHA, ¡an ¡operator ¡shall ¡allow ¡MSHA ¡to ¡inspect ¡and ¡copy ¡informa4on ¡related ¡to ¡ an ¡accident, ¡injury ¡or ¡illness ¡which ¡MSHA ¡considers ¡relevant ¡and ¡necessary ¡to ¡verify ¡a ¡report ¡of ¡ inves4ga4on ¡required ¡by ¡§ ¡50.11 ¡of ¡this ¡part ¡or ¡relevant ¡and ¡necessary ¡to ¡a ¡determina4on ¡of ¡ compliance ¡with ¡the ¡repor4ng ¡requirements ¡of ¡this ¡part. ¡ ¡ ¡ 30 ¡CFR ¡§ ¡50.41 ¡ ¡ ¡ ¡ ¡ ¡ ¡ ¡
Big ¡Ridge, ¡Inc. ¡et ¡al. ¡v. ¡Secretary ¡of ¡Labor , ¡ ¡715 ¡F.3d ¡631 ¡ (7 th ¡Cir. ¡2013) ¡ In ¡October ¡2010, ¡MSHA ¡acted ¡on ¡a ¡new ¡and ¡broader ¡interpreta4on ¡of ¡exis4ng ¡regula4ons ¡ • that ¡require ¡mine ¡operators ¡to ¡report ¡to ¡MSHA ¡all ¡mine-‑related ¡injuries ¡and ¡illnesses ¡ suffered ¡by ¡mine ¡employees. ¡ ¡ ¡ It ¡informed ¡39 ¡mine ¡operators ¡that, ¡in ¡addi4on ¡to ¡providing ¡the ¡injury ¡and ¡illness ¡reports, ¡ • they ¡would ¡be ¡required ¡to ¡permit ¡an ¡MSHA ¡inspector ¡to ¡review ¡employee ¡medical ¡and ¡ personnel ¡records ¡during ¡their ¡next ¡inspec4ons. ¡ ¡MSHA ¡claimed ¡that ¡reviewing ¡employee ¡ medical ¡and ¡personnel ¡records ¡would ¡enable ¡it ¡to ¡verify ¡that ¡the ¡mines ¡have ¡not ¡been ¡ under-‑repor4ng ¡miners ’ ¡injuries ¡and ¡illnesses. ¡ ¡ ¡ Two ¡mine ¡operators, ¡subsidiaries ¡of ¡Peabody ¡and ¡Massey ¡Energy, ¡and ¡refused ¡to ¡provide ¡ • the ¡records. ¡ ¡Mine ¡personnel ¡complied ¡with ¡the ¡requests ¡to ¡produce ¡the ¡7000-‑1 ¡and ¡ 7000-‑2 ¡reports ¡and ¡the ¡number ¡of ¡employees ¡working ¡at ¡the ¡mine ¡for ¡each ¡quarter ¡ (items ¡1, ¡2, ¡and ¡4), ¡but ¡they ¡refused ¡to ¡produce ¡payroll ¡and ¡medical ¡records ¡(items ¡3 ¡and ¡ 5). ¡ ¡ ¡ ¡ ¡ ¡ ¡
