Major r Public c Project t Construction n Noise e Variance e Public Meeting SDCI - August 1, 2019
AGENDA • Major Public Project Noise Variance • Exterior Sound Level Limits • Granting a Noise Variance – Part 1 • Granting a noise Variance – Part 2 • Criteria for Approval • Next Steps in the Process • Public Comment • Questions
MAJOR PUBLIC PROJECT NOISE VARIANCE • This is a permit process for large public projects to: • Offer flexibility in construction hours and activity • Limit traffic impacts related to construction activity during normal hours • Reduce duration of the overall construction projects • Manage noise impacts during evening hours
EXTERIOR SOUND LIMITS Dis istrict t of of Sou Sound nd Sou Source e Dis istrict t of of Rece ceiv ivin ing g Prop opert rty y Residential Commercial Industrial (dB(A)LEQ) (dB(A)LEQ) (dB(A)LEQ) Residential 55 57 60 Commercial 57 60 65 Industrial 60 65 70
EXTERIOR SOUND LIMITS • Construction normally occurs 7am – 10pm (Mon-Fri) and 9am – 10pm (Weekends & Legal Holidays) • In general, the Seattle Noise Ordinance allows noise to exceed sound limits by 25 decibels (averaged) during normal construction hours • After 10pm, those exceedances go away • This project has requested relief from noise limits described in the noise ordinance and WSDOT will be presenting their project tonight
GRANTING A NOISE VARIANCE – PART 1 • SDCI Noise Abatement group may grant variances necessary for nighttime construction activities such as: • Allowing tower cranes and oversized equipment that have limited access during normal working hours • Utility work that requires shutting off essential services to a business and/or households • Standards for granting a noise variance state (SMC 25.08.590): • The noise occurring or proposed to occur does not endanger public health or safety • The applicant demonstrates that the criteria required for the variance are met
GRANTING A NOISE VARIANCE – PART 2 • In reviewing all variance applications, the Noise Abatement Group reviews the information provided that justifies the need for a variance: • Whether the applicant’s information and analysis is accurate and complete • The type of sound levels proposed by the variance • The proposed times and duration of the sound • The topography and population density of the area • Whether the public health and safety is endangered • Whether proposed noise mitigation measures are likely to be effective
CRITERIA FOR APPROVAL • The City may grant a Major Public Project Construction Noise Variance (MPPCNV) to provide relief from the exterior sound limits only to the extent the applicant demonstrates that compliance with the levels would: • Be unreasonable in light of public/worker safety or cause the applicant to violate other applicable regulations, including but not limited to regulations that reduce impacts on the transportation infrastructure or natural resources; or • Render the project economically or functionally unreasonable due to factors such as financial cost of complying for the duration of the major public project
NEXT STEPS IN THE PROCESS • The comment period has been extended to accept comments through August 2nd, 2019 • The decision will be published in The Seattle Times and our Land Use Information Bulletin • The appeal period takes place during the first 10-days of the waiting period
PUBLIC COMMENT Application #6733975-NV • We want to hear your comments! Please choose one of the following three options: – Make a verbal comment tonight by signing up on the “Comment Sign - Up Sheet” located at the sign- in table near the entrance. Tonight’s comment period will be starting after the presentations conclude. – Provide a written comment tonight by filling out a comment card located at the back of the room. – Send an Email to: PRC@seattle.gov *As a reminder, the comment period ends on August 2, 2019

SR 520 SR 520 night nighttime time con constr struct uction ion wor ork Why is nighttime work necessary? • SR 520/I-5 Project construction during nighttime hours is necessary in order to: – Provide a safe work environment for the contractor and traveling public – Avoid adding to existing congestion on SR 520 and I-5 – Minimize impacts to the community and cost to taxpayers caused by extended project duration and significant daytime traffic impacts When would the variance be applicable? • During nighttime construction hours of the SR 520/I-5 Project, defined as 10 p.m. to 7 a.m. on weekdays, and 10 p.m. to 9 a.m. on weekends and legal holidays • The I-5 express lanes are closed nightly which allows for construction activities to occur without impacting highway operations SR 520 project work site at night 17
Wha hat t we he e hear ard d fr from th om the e co commun mmunity ity Questions and comments about key topics: • Clarification of types of construction activities anticipated for nighttime construction • Noise-mitigation measures to reduce nighttime construction-noise impacts • How nighttime construction noise limits will be monitored and enforced • May 29, 2019 SR 520/I-5 Project information Construction noise impacts for residents in session the vicinity of the SR 520/I-5 interchange • How WSDOT property under I-5 will be used during construction 18
What’s included in WSDOT’s application? • Project descriptions and proposed construction activities • WSDOT’s baseline noise measurements and proposed nighttime noise limits for the SR 520/I-5 Project • A Noise Management and Mitigation Plan. • An overview of planned public outreach and process to resolve noise complaints during SR 520/I-5 Project construction • How construction noise will be monitored and how the contractor will comply with MPPCNV requirements 19
