Key Milestones Milestone When Output • Minister announced 21 March 2011 • Confirmation of decision and decision to extend project team established cost recovery for H&S • Public and formal July – Oct ’11 • Formal consultation of how consultation cost recovery will work • ‘Dry run’ of Oct - Dec ’11 • Ways of working tested with processes and small groups / team procedures • ‘Shadow Running’ of Feb – Mar ’12 • Ways of working tested processes and across all teams procedures • Formal launch April 2012 • Cost recovery is operational
Fee for Intervention • Effective from as early as April 2012 • Compliant businesses will not pay a penny • Recovery of costs for formal intervention • Current estimated costs £133 per hour • Prosecution costs sought through the courts • Monthly invoicing with 30 days to pay • Disputes and queries process will be established
Material breach “In the opinion of the inspector a breach of health and safety law has been identified, which requires HSE’s formal intervention in supporting the business in putting matters right”
Excluded from Scope • Existing permissioning regimes (high hazards industries) • Local Authority enforced premises • Self-employed dutyholders (putting only themselves at risk) • Non-Health and Safety at Work Act
Pre-implementation • ‘Dry run’ underway (Oct to Dec) • Across Chelmsford, Norwich, Bedford, Basingstoke, Newcastle and Construction Division • Testing processes and systems • Gathering feedback from colleagues and dutyholders • ‘Shadow run’ involving all staff - Feb 2012
