Airborne Implementation Status • According to IATA figures provided by AU associations, 1000-1200 aircraft are equipped to use the service within Europe. • According to European Single Sky Implementation (ESSIP) 2012 report, 15% of aircraft are equipped based on flight plan information. • According to Interim Deployment Steering Group (IDSG) report, 40% of airline operators will be ready to use Datalink by 5 Feb 2015, with the remainder ready by 2017. www.eraa.org twitter.com/eraaorg

What the Commission are doing During the DLS IR workshop on 17 June 2014 the Commission proposed a two step approach on the way forward with respect to the DLS Implementing Rule. • STEP 1 : "suspend" the obligation requirements until a validated technical solution is available, while maintaining legal certainty. i.e. extend the "ground application" and airborne “retrofit” o dates o extend dates for automatic exemptions www.eraa.org twitter.com/eraaorg

What the Commission are doing • STEP 2: "review" and "re-assess" the regulation on the basis of sound validated technical solution, including: review of the scope, exemptions criteria, and o potential impact (cost/benefits) consider incentives and enforcement criteria o • Work to be carried out by the SJU and results reviewed by legal conditions through an EASA regulatory process. www.eraa.org twitter.com/eraaorg

What we are doing Both prior to and following the release of the EASA report into Datalink performance, ERA and other AU associations have been lobbying the Commission with a view to amending the Obligations of (EC)No 29/2009. This in an attempt to seek relief in the timing and technical problems reported by stakeholders concerning the ground and airborne deployment of data link communication. www.eraa.org twitter.com/eraaorg

What we have proposed Proposed Change Requested by AUs Obligations of Regulation EC No. 20/2009 Forward fit date to be extended to 1 Jan 2016 Forward fit: 1 Jan 2011 Retrofit date to be extended to 5 Feb 2018 Retrofit: 5 Feb 2015 Dual stack requirement date extended to Duel Stack requirement date: 1 Jan 2014 1 Jul 2016 Aircraft that cease operations date extended to Aircraft with COA prior to 1 Jan 1998 which 1 Jan 2001 / 31 Dec 2023 cease operations prior to 31 Dec 2017 will be eligible to be exempted. What we have proposed The proposed new dates are conditional on the following issues being resolved: • that a “validated technical solution” to solve the actual ATN/VDLM2 problems is based on the EASA recommendation in support of the introduction of multi-frequency for which it is assumed that a simple avionic software upgrade would be required. • that the performance of the validated technical solution should be proven to work satisfactory in practice in a “full scale” environment according to its requirements. • SITA and ARINC are fully aware of this solution and are committed to contribute to establish a timely and working multi-frequency environment. • The ground must be ready to be compliant with a multi-frequency solution by Feb 2017 in order to keep the momentum and to keep pilots motivated. • The DL Program Manager is installed and active by end of 2014. www.eraa.org twitter.com/eraaorg

  19. What we have proposed If these Conditions cannot be met by different stakeholders, AUs are requesting further flexibility in timing from the Commission as highlighted below.
