SUBJEcT: THE CONSTRUCTION PRODUCTS DIRECTIVE IN THE PRACTICE THE CONSTRUCTION PRODUCTS DIRECTIVE (COUNCIL DIRECTIVE 89/106/CE) Council Directive 89/106/EEC of 21 December 1988 on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products. 15.02.2005 Seite 2
GENERAL Purpose: Taking down technical trade impendings in the European Union without a loss of the former protection level Aim: Construction products to be sold, have to be suitable. Essential requirements to construction products: 1.Mechanical resistance and stability 2. Safety in case of fire 3. Hygiene, health and the environment 4. Safety in use 5. Protection against noise 6. Energy economy and heat retention 15.02.2005 Seite 3
APPLICATION RANGE Raw materials Building elements Aggregates for concrete, mortar, asphalt and Elastomeric seals road construction Prefabricated chimneys Aggregates for railway ballast, armourstone Radiators and convectors Natural stone Lighting columns Cement and building lime WC, Kitchen sinks Gypsum blocks Building materials Building equipment Fire detection and fire alarm systems Masonry units Building hardware (doors, locks) Concrete and cement pipes and fittings Fixed firefighting systems Concrete and clay pavers Smoke and heat control systems Terrazzo and ceramic tiles Wastewater lifting plants Thermal insulation products Fixed ladders for manholes Wood-based panels Geotextiles and geotextile-related products At the moment there are about 157 harmonized standards 15.02.2005 Seite 4
STANDARDS Technical Specifications: (Requirements of the Construction Product Directive) - standards EN - harmonized standards with a mandated EN + Annex ZA The Annex ZA prescribe the tests and the documentations for the realisation of conformity In this case it is forbidden to sell the construction product without testing and attestation of the conformity (CE – Mark) - National standards / directions (as national documents of application) 15.02.2005 Seite 5

BODIES INVOLVED IN THE ATTESTATION OF CONFORMITY Certification body - impartial body, governmental or non-governmental, having competence and integrity Inspection body - impartial body having the organization, staff, competence and integrity Testing laboratory -with calibrated laboratory equipment -i.e. accredited laboratory - In case of System 1+/1 everything may be performed by one and the same body or by different bodies - In case of System 2+/2 the inspection body and /or the testing laboratory involved in the attestation of conformity carries out acts on behalf of the certification body. The certification and inspection bodies and the test laboratories of a certification body have to be accredited by a national government institution and notified by the EU. Every “notified body” gets its own identification number. 15.02.2005 Seite 7

Trade and CE Legal issues: - Products for which a mandated and harmonized norm is valid are allowed to be brought into traffic only with the CE-Mark (law) - If you are dealing with such products, you have to be aware that - your products have to be withdrawn from the market by the national market authority such as the customs - in case you are bidding for a tender you are not eligible - in case of a event of a damage you may loose your cover of insurance 15.02.2005 Seite 19
