Breathing Space Introduction - What is Breathing Space? It’s a scheme offering formal protection for individuals who have problem debt, backed by government legislation. It means: A 60 day period of protection for individuals ● Longer protection for individuals in mental health crisis treatment ● Creditors must pause enforcement action ● Creditor contact relating to repayment of debt must stop ● Interest and default fees & charges are frozen ● Protections dependent on the individual continuing to engage ● with debt advice

Breathing Space Roles & Responsibilities Insolvency Service Money Adviser Gather information from the individual ● Provide the IT service that money ● advisers will use to submit applications Determine eligibility ● Manage access to the IT service for ● Verify personal details ● money advisers and creditors Obtain & verify details of liabilities ● Produce and maintain guidance for ● Determine that Breathing Space is ● stakeholders appropriate Issue notifications when Breathing Space ● Maintain contact with the individual in debt ● starts and finishes Liaise with creditors when necessary ● Report non-compliance to regulator ● Escalate continued non-compliance by ● creditor
Breathing Space Mandatory fields Clients full name: This is likely to be in a First/Middle/last name basis format. Clients D.O.B: This is likely to follow ISO8601 standard Clients most recent address: We will validate against a postcode checker but MA responsible for validating address entered belongs to the client Business trading name if applicable: Any validation would be a Money Adviser responsibility At least one creditor: MA adviser is responsible for confirming the creditor with the client. Non mandatory fields Debt amount: Encouraged but no requirement to collect this information but will be in format £0.00p Debt reference identifier: Encouraged but no requirement to collect this information Additional reference numbers: No requirement to collect this information Previous names: Should be recorded if relevant Previous addresses: Encouraged but no requirement to collect this information

Breathing Space Future Engagements As we progress continuous engagement with other government departments and creditors will play a key role in preparing for Breathing Space go-live. As such we are proposing the following engagements into Private and Public BETA. Creditor technical working group The technical working group will be meeting every 4 weeks. Please let us know if you would like to ● be involved. Dedicated enquiry channel In order for us to collate and manage enquiries outside of the working groups you can submit ● questions to breathingspaceproject@insolvency.gov.uk Technical working group slack channel ● Show and Tell We will aim to give an update on our progress in this format every 6-8 weeks ●
