Lower Mississippi River Basin in Minnesota • 7,266 square miles (4,650,100 acres) • All or part of 17 counties • Roughly two-thirds cultivated • Population: 600,000-700,000 concentrated in south Metro. area and around 7 major cities • 39 bacteria-impaired listed reaches in 2004
History • Oct. 2002 – Denial of Contested Case Hearing Request • Nov. 2002 – Approval by USEPA • 2003 – MCEA Challenge of USEPA Approval in Federal District Court • 2003-Present – Implementation Plan Development and On-Going Fecal Coliform Reduction Efforts • June 2005 – District Court Order • July-Oct. 2005 – Revisions and Public Notice
District Court Order • The revised TMDL shall be established at a level necessary to implement the applicable water quality standards for each reach impaired with fecal coliform contamination. • The revised TMDL shall contain a margin of safety that accounts for lack of knowledge concerning the relationship between effluent limitations and water quality.
District Court Order (cont.) • The revised TMDL shall properly account for straight pipe septic systems in the wasteload allocation of the TMDL. • The State of Minnesota is allowed 90 days from the date of entry of final judgment in this case to give pubic notice and to seek comment on, a proposed amended or replacement Regional TMDL …….
