Purpose of the Clarification Meeting • To assist Contractors with understanding the requirements in order that they may submit a responsive tender; • To ensure that the Contractors have access to information contained in this Presentation. This Presentation will serve as Minutes of the Meeting and will assist the Contractors when compiling the Tender Documents • Explains the necessity to accurately and clearly supply information such as email addresses, office telephone numbers, cell phone numbers and fax numbers. This will ensure tenderers are provided with feedback on their Tender submission timeously . • All clarifications and questions with answers, will be published on Eskom’s Tender Bulletin 4

Mandatory Requirements The following Mandatory Requirements must be submitted at tender closing: • Meet the eligibility criteria for a tenderer • Submit one (1) original plus one (1) hard copy of the original tender to Eskom • Submission of the mandatory commercial tender returnables as at stipulated deadlines. • Central Supplier Database (CSD) number (MAA………) • Contractors will need to provide proof that they have applied or currently have a CE CIDB grading of a Level 8CE PE and above at Tender Closing. • Minimum subcontracting requirement 20% 9

Mandatory Requirements cont… Tenderers shall submit the following Mandatory Returnables for B- BBEE Contribution: • EME’S valid Sworn Affidavit (DTI template) must be submitted and attested / signed by a Commissioner of Oaths; • QSE’s valid Sworn Affidavit (DTI template) must be submitted and attested / signed by a Commissioner of Oaths OR B-BBEE certificate from SANAS approved agency • LME’s valid and certified copy of a B -BBEE Certificate issued by a SANAS Accredited Verification Agent, or Note : Joint Ventures can only submit a Consolidated , Valid and Certified Copy of B-BBEE Certificate issued by a SANAS Accredited Verification Agency specific for this tender. 10

Mandatory Requirements cont… In addition to the B-BBEE Certificate, the following documents must also be submitted: • Tenderers shall submit certified copies of CIPC registration documents; • Certified Identity Document(s) of Company Shareholders or Members; • Certified copy of Shareholders certificate [for Pty (Ltd) entities]. Tenderers are required to subcontract a minimum of 20 % to: • EME or QSE entities at least 51% owned by Black People • EME or QSE entities at least 51% owned by Black Youth; • EME or QSE entities at least 51% owned by Black Women; • EME or QSE entities at least 51% owned by Black People with Disability; 11

Functional Requirements Functionality Requirements - Technical It is a mandatory requirement that the technical returnable be contained within the technical section of the submission and the inclusion of any technical returnable in any other segment of the submission shall not be considered for assessment. Tenderers who do not meet the threshold for functionality scoring will be disqualified and not be evaluated further.
