Ligget and failure to warn re addiction 1990s: State cost reimbursement iawsuits 1999 to present: U.S. DOJ RICO lawsuit Findings and Legai Conclusions Defendants jointly engaged in a massive public relations campaign to fraudulent deny and distort the health consequences of smoking and second hand smoke. Defendants actively concealed adverse scientific findings, entered into agreements not to conduct research, and used lawyers to control research so that it would serve the purposes of litigation and public relations. Defendants fraudulently concealed the addictive properties of nicotine. Defendant fraudulently claimed that filtered and tow tar cigarettes were a healthy alternative to quitting. Defendants marketed their products to youth. Defendants engaged in spoliation to conceal the true facts.

Family Smoking Prevention ana Tobacco Control Act (June 22, 2009) The Act gives the Food and Drug Administration the power to regulate the tobacco industry. A signature element of the law imposes new warnings and labels on tobacco packaging and their advertisements, with the goal of discouraging minors and young adults from smoking. The Act also bans flavored cigarettes, places limits on the advertising of tobacco products to minors and requires tobacco companies to seek FDA approval for new tobacco products.
