Overnight Camping or Sleeping in Vehicles December 19, 2018
Amendment The proposed amendment brings the municipal code into compliance with recent court rulings by limiting the hours on the prohibition of camping or sleeping in vehicles.
Important Legal Decisions • Desertrain v. City of Los Angeles (2013): Court ruled that the city’s ordinance which prohibited the use of a vehicle as living quarters was unconstitutionally vague. • Martin vs. City of Boise (2018): Court ruled that without the option of sleeping indoors, you cannot criminalize the indigent for sleeping outdoors on public property. Cities may still limit the time and place where people sit, lie, and sleep in public.
§18.36.040 Proposed Revisions It shall be unlawful to park any trailer or any motor vehicle on any public street, highway, roadway, alley, parking lot, or other public place for the purposes of camping or sleeping between the hours of midnight and 5:00 a.m.
