Scrap Tire Fee • Fee of $1.00/New Tires Sold (wholesale); • $0.50 to Ohio EPA for Scrap Tire Program; • $0.50 to ODA Soil & Water Conservation Program; and • Fee Sunset Date is June 30, 2020.
Scrap Tire Management Fund Priorities for Use of Tire Funds: 3734.85 (B) 1. Accumulations that the director finds constitute a fire hazard or threat to public health ; 2. Accumulations of more than one million scrap tires ; 3. Accumulations of scrap tires in densely populated areas ; 4. Other accumulations of scrap tires that the director or board of health determines constitute a public nuisance ; 5. Any other illegal accumulations of scrap tires.

No-Fault Program Eligibility Number of Scrap tires • No less than 100 scrap tires • No more than 5000 scrap tires – Specific to tires, not PTEs – Local Government applicants may aggregate tires from public properties within their jurisdiction
No-Fault Program Eligibility Statutory Criteria 1. Tires placed after owner acquired title, OR tires placed before owner acquired title by bequest or devise; 2. Property owner did not have knowledge of or took actions to prevent tires from being placed on property; 3. Property owner did not participate in or consent to placing the tires on the property; 4. Property owner received no financial benefit; 5. Property title was not transferred to evade liability; and 6. Responsible party who placed tires on the property was not acting as an agent for the property owner. OAC 3734.85 (E)

Enforcement Removals 3734.85 • Applicable to accumulations of 100+ tires that do not meet “No-Fault” criteria. • Requires: – Removal order(s) issued by Director of Ohio EPA; – Failure of owner/responsible party to clean up in 120 days; – Formal access to property (judicial or signed agreement); – Lien be placed on the subject property following a removal action.
