Some Changes to Note • Definition of Industrial Waste has changed: “ Industrial Waste means solid waste that is generated by manufacturing or industrial processes and that is not a hazardous waste… ” • Definition of Captive Facility changed: “ Captive facility means a landfill or coal ash impoundment that accepts for disposal, and accepted for disposal during the previous calendar year, only non-hazardous industrial waste generated only by the owner of the landfill or coal ash impoundment.” 4

Changes to “ Traditional” Solid Waste Program • Processing Plants and Transfer Facilities are combined under one permit or license to better reflect current solid waste management realities • Updated post-closure section, including functional stability evaluations and introduction of custodial care concept • Financial Assurance requirements are updated to better reflect the true cost of closing and maintaining closed facilities. 1 1 1 1
Authorization Levels – Notification • All waste diversion centers • Smaller M aterial Recovery Facilities, compost facilities and Anaerobic Digesters • Requires an annual notification on a form and format designated by the Department 1 1 2 2
Authorization Levels - Registration • M id-sized M aterial Recovery Facilities, Compost Sites and some Anaerobic Digestors • Submission of a Registration Form every 5 years on a form and format provided by the Department • Submission of certain materials management data annually on a form and format provided by the Department • Application fee of $750.00 1 1 3 3
Requirements for Registered Facilities • Pay a registration fee • Pass a yearly inspection • Comply with local zoning • Do not create nuisance conditions • Do not violate water quality standards of Part 31 • M anage a maximum of 5,000 cubic yards of compostable material per acre • Report on a yearly basis the amount of compostable material managed at the site. 1 1 4 4
