New NNSA Initiative • NNSA Small Business Subcontracting Compliance Review – Designed to follow methodology of the SBA Subcontracting Compliance Reviews – NNSA reviews each M&O contractor’s subcontracting performance against their Subcontracting Plan – NNSA measures performance against all 15 elements of the subcontracting plan 13
New NNSA Initiative • NNSA Subcontracting Compliance Review – NNSA Issues Rating of M&O Subcontracting Performance • Outstanding Exceeded all negotiated goals or exceeded at least one goal and met all of – the others. Has exceptional success with initiatives to assist, promote and utilize small business – An exemplary program that could be used as a model by other contractors in similar industries. • Highly Successful – Met all of its negotiated goals in the traditional socio-economic categories (SB, SDB, and WOSB) and met at least one of the newer socio-economic goals (HUBZone small business, VOSB, and SD/VOSB) Goes above and beyond the required elements of the program and can – provide documentation and success stories to support such efforts. • Acceptabl e Demonstrated a good-faith effort to meet all of its goals, but has not met – the rigorous criteria for a Highly Successful or Outstanding rating – Fulfills the requirements of its subcontracting plan and the regulations – Subcontracting Report for Individual Contracts and Summary Subcontract Reports are complete and accurate. 14
New NNSA Initiative • NNSA Subcontracting Compliance Review – NNSA issues Rating of M&O Subcontracting Performance • Marginal Deficient in meeting key subcontracting plan elements – Subcontracting Report for Individual Reports and Summary Subcontract – Reports are not correct • Unsatisfactory – Noncompliant with the contractual requirements of FARs 52.219-8 and 52.219-9 – Contractor’s management shows little interest in bringing its program to an acceptable level or is generally uncooperative 15
New NNSA Initiative • Why is it important? – NNSA recognizes the importance of small business participation in our ability to accomplish our mission – NNSA utilizes Small Business Participation as a Primary Source Selection Criterion in our M&O solicitations – Subcontracting Program Ratings of M&O contractors may be considered in our evaluations of proposals and selection for award – NNSA is evaluating how these ratings may be used in Award Fee Determinations 16
