We noticed that while the version submitted yesterday removed the TAV recommendation, we missed removal of it from the summary page. This version has that reference removed. FYI, please note that ENR’s Aileen Stevens will present the ppt at the Hearing. I understand the confusion. It’s not imperative at this stage. ENR will recommend this path forward of writing in a separate letter to the Board noting this recommendation and the City’s agreement as you suggest. For the record, it is not ENR’s understanding that this is new evidence. It is a recommendation that was included in the first submission to the Board upon review of the initial application. This, as I understand, is still evidence on the record for this file. Please find attached a new copy of the ppt that has reference to this recommendation removed. Thank you, Cheers, Todd M. There can be no new evidence introduced at the hearing. Since your recommendation for a TAC was not included in your intervention, it cannot be brought forward on the day of the hearing, even with an explanation. However, your suggested path forward of writing to the Board noting this recommendation and the City’s agreement is fine. I will place it on the record. References to this recommendation must be removed from your presentation. I trust you will re ‐ submit this to me shortly. ENR ppt presentations and related written materials are required to be reviewed and authorized by the Deputy Minister prior to submission, which adds short time requirements on our end. For the remainder of this YK City hearing process, it is requested to please cc myself and Diep Duong directly on all materials sent to ENR. For this current project, this will help ENR facilitate the any tight timelines in a more expedient manner in the future. Please also note this presentation includes reference to a recommendation regarding a TAC that was included in the first ENR written submission for this process. It was included in various recommendations, and was also discussed with the City and agreed to in our meeting. However, through consultation regarding this issue with the City and Board staff, ENR determined this Recommendation was more suited as stand ‐ alone, and was edited for re ‐ submission accordingly. 2
However it was inadvertently not included in the second written submission. ENR will address and explain this issue at the Hearing. ENR requests that it may provide a updated written version of this recommendation, and that will also demonstrate confirmation of agreement by the City. It’s proposed this will help provide benefit of the record, and for Board members, Board staff, and Interveners. Please advise on the suitability of this suggested path forward. Thank you.
