  4. F INDINGS The Plat Officer has reviewed the request and finds the following: 1. The proposed building setback adjustment will not increase the density of the subdivision. 2. The building setback adjustment will not have the effect of nullifying the intent and purpose of the Subdivision Ordinance. 3. The building setback adjustment will not be detrimental to the public health, safety or welfare or injurious to other property or improvements in the neighborhood in which the property is located. 4. The owner has secured letters of support from all the adjacent property owners. Since there is no homeowners association for the subdivision, and there exists a recorded Declaration of Restrictions dated August 11, 1972, which requires a 60 foot setback, the owner has informed over fifty percent of the residents in this unit of the proposed building setback adjustment and has received a supportive response. Notwithstanding this recommendation, other residents in the subdivision are free to take legal action to enforce any portion of the recorded Declaration of Restrictions.
