Since 2 October 2017… • All MS use CDS/ EU TP and UUM&DS (except for DK and NL which are carrying out further user testing with a view to join in the near future) • Changes from MS in the choice of the architectural approach should be notified immediately to the Commission (eg. recent info from FR) so that the published info can be adapted and economic operators informed 7

Authentication vs Submit an application (central system) • Article 9(1) UCC – " EO ( … ) shall register with the customs authorities responsible for the place where they are established ". • Article 22(1) para. 3 UCC – " Except where otherwise provided, the competent customs authority shall be that of the place where the applicant's main accounts for customs purposes are held or accessible, and where at least part of the activities to be covered by the decision are to be carried out . 14

Authentication vs Submit an application (central system) - examples • EO established in LU (EORI number) and wants an autorisation for RSS in PT, ES and FR. • The authentication is done in the UUM&DS system using the LU credentials. • The application shall be submitted in LU (EU TP) and shall include PT, ES and FR as involved MS's. 15

  16. Authentication vs Submit an application (central system) - examples • The RSS authorisation follows the general rule of art. 22(3) par.3 UCC. • PT, ES and FR shall be consulted according to article 195 IA. 16

Authentication vs Submit an application (central system) - examples • EO established in LU (EORI number) and wants an authorisation for the status of authorised consignee for TIR operations in BU. • The authentication is done in the UUM&DS system using the LU credentials. • The application shall be submitted in BU (EU TP). 17

Authentication vs Submit an application (central system) - examples • This authorisation is one of the exceptions to art. 22(3) par.3 UCC, according to article 186 DA. • " For the purposes of TIR operations, applications for the status of authorised consignee (…) shall be submitted to the customs authority competent to take the decision in the Member State where the TIR operations of the applicant are due to be terminated. " 18

  24. • Temporary solution for the Customs office list => each MS to create role of Decision Taking Customs Authority (DCTA) per type of customs decision in CSRD2 & exported to DDS2-COL Official note sent by TAXUD to the Member States on 27 th of October, with the steps • for the MS to configure the 22 COL roles in CS/RD2 • Deadline to setup Customs Offices for the 22 types is 30 November 2017 • Blocking bugs on CDMS/TP and quick wins on TP usability were implemented (weekly releases) 24

Customs Procedures • List of procedures to be extended with codes 80 (transit) and XX (temporary storage) • As per amendment to I.A., list of procedures to be further extended with codes XR (public customs warehouse type I), XS (public customs warehouse type II), XU (private customs warehouse)

  28. Upcoming changes within next 2 months 2. Mandatory  Optional fields • All the following changes were foreseen for v2 (2019) but will be implemented in a version 1.x (2017). • General principle: • Quick fix : the elements are set to ‘Optional’

(The reference number was always mandatory even though the user selected “No” to the “Guarantee Indication”). • Simplified Declaration – Commodity code (Type of Goods) (As per the adopted legislation, this element is not required for SDE) • Customs Procedure Concerned – No Previous Procedure: (The Decision Reference Number is currently mandatory)

  30. Upcoming changes within next 2 months 2. Mandatory  Optional fields • Person Responsible for Excise Formalities (CCL) is mandatory. • Commodity Code (The TARIC Code [extension] should not always be mandatory). • Quantity of Goods: (The element is not required for Temporary Storage)

  31. Upcoming changes within next 2 months 3. Geographical Validity • When the user chooses a validity in all MS, he can still encode MS below (field “Country”); • Once the union-wide validity is selected, no MS should be then selected in the “Union” validity (C0273).

  32. Upcoming changes within next 2 months 4. Comprehensive Guarantee Application – Missing fields • Some fields were not displayed (level of guarantee); • This will be corrected.

  33. Changes that require further analysis • The following requests have been gathered from the different MS needs. • However, they still need to be refined by MS, Trader and DG TAXUD. • Dedicated project groups and other workshops will be organised by DG TAXUD in the following months.

Changes that require further analysis • Attachments • Delete authorisation entered by mistake • Notifications of traders by email; + legal issue • Revision of the timers • Archiving of expired authorisation, notifications, etc. • Possibility for the CO to encode information on behalf of the trader after temporary failure of the system • Application for amendment < > Amendment request
