Government’s ¡Role ¡in ¡Regulating ¡ Medical ¡Care The ¡federal ¡government ¡has ¡a ¡legitimate ¡role ¡to ¡play ¡in ¡ regulating ¡medical ¡care: ¡ 4 Ensuring ¡safety ¡of ¡drugs ¡and ¡devices 4 Protecting ¡the ¡health ¡and ¡welfare ¡of ¡vulnerable ¡populations, ¡including ¡ the ¡elderly ¡(Medicare), ¡the ¡poor ¡and ¡disabled ¡(Medicaid), ¡children ¡ (CHIP), ¡veterans(VHA), ¡and ¡other ¡disadvantaged ¡or ¡special ¡needs ¡groups 4 Setting ¡safety ¡standards ¡ 4 Promoting ¡public ¡health 4 Sponsoring ¡clinical ¡research ¡ 4 Promoting ¡the ¡education ¡and ¡training ¡of ¡the ¡physician ¡workforce All ¡states ¡also ¡have ¡laws ¡and ¡regulations ¡to ¡protect ¡public ¡ health, ¡safety, ¡and ¡welfare. 3

Government ¡Abuse ¡ In ¡certain ¡areas ¡of ¡health ¡care, ¡state ¡legislatures ¡are ¡abusing ¡their ¡power ¡to ¡ impose ¡an ¡ideological ¡agenda ¡on ¡health ¡care ¡providers ¡and ¡patients. ¡ ¡ Examples ¡of ¡political ¡intrusion ¡in ¡the ¡patient-­‑provider ¡ relationship ¡include: 4 Prohibiting ¡providers ¡from ¡discussing ¡with ¡their ¡patients ¡risk ¡factors ¡that ¡ may ¡affect ¡their ¡health, ¡as ¡recommended ¡by ¡evidence-­‑based ¡ guidelines ¡of ¡ care; 4 Requiring ¡providers ¡to ¡give—and ¡patients ¡to ¡receive—diagnostic ¡tests ¡or ¡ medical ¡interventions ¡that ¡are ¡contrary ¡to ¡clinical ¡evidence, ¡the ¡provider’s ¡ professional ¡judgment, ¡or ¡patient ¡preferences; ¡ and 4 Laws ¡limiting ¡the ¡information ¡that ¡providers ¡can ¡disclose ¡to ¡patients ¡in ¡ patient ¡care ¡or ¡mandating ¡providers ¡communicate ¡information, ¡the ¡clinical ¡ relevance ¡or ¡content ¡of ¡which ¡is ¡not ¡supported ¡by ¡scientific ¡evidence ¡or ¡ substantial ¡public ¡health ¡concerns. 4

Interference ¡and ¡Abortion ¡Care Safe, ¡accessible ¡abortion ¡care ¡has ¡been ¡the ¡most ¡common ¡target ¡for ¡this ¡ type ¡of ¡overreach. ¡ Abuse ¡of ¡informed ¡consent ¡ § Forced ¡delays ¡in ¡care § Over-­‑regulation ¡ of ¡clinics ¡and ¡doctors ¡to ¡force ¡shutdown ¡ § Prohibiting ¡or ¡proscribing ¡the ¡way ¡care ¡is ¡provided ¡ ¡ § 5
