Federal HIT Issues Update • Latest from Capitol Hill – Legislative efforts to address MU • AMA pushing for “blanket” hardship exemption from penalty for 2015 performance (2017 penalty). Hardship exemptions are already allowable under the law and given by CMS annually. • Changes to MU: S3 timing, framework beginning to get notice. • Regulatory Update – HANYS submitting comments of MU S3 today. MU Stage 3 Comments • HANYS comments encourage the agency to make changes to the program’s timeline and modify key characteristics, including: – Delay required start of S3 until 2019 – allow for more experience with S2 and the rollout of the new physician payment program. – Eliminate one-size fits-all approach to achieving MU. – Adjust Stage 3 measures to reflect more practicable requirements and continued flexibility. New York’s e-Prescribing Mandate • Requires all NYS prescriptions (both controlled and non-controlled substances) to be issued electronically with limited exceptions. • Implementation date: March 27, 2016. • E-prescribing is currently permissible in NYS. • HANYS seeking implementation status updates from HANYS members. • New BNE resources: health.ny.gov/professionals/narcotic/electronic_prescribing/ Healthcare Association of New York State www.hanys.org
Temporary Waivers • Law allows for temporary waivers to the mandate, for discrete circumstances, including for reasons of: – “technical limitation,” – “economic hardship,” or, – “other exceptional circumstances demonstrated by the practitioner.” • Waiver guidance and waiver process not yet available; expected to be released as soon as this week. • Two options for submitting waivers: hospital facilitated OR practitioners apply directly through Health Commerce Site. Option 1: Hospital Facilitation of Waiver • HANYS members seeking to facilitate a waiver on behalf of your employed or affiliated physicians and other practitioners for each site for which such practitioners will need a waiver will be expected to provide the following, according to BNE: – narrative explanation of the rationale for the waiver—must fall under one of the three categories spelled out in the law – information about each practitioner in a CSV file: Profession Code and New York State license number ; – electronic signature of each practitioner; and – additional identifiers such as Article 33 license numbers and Official New York State Prescription (ONYSRx) form shipping address for each site seeking a waiver. Option 2: Individual Practitioners File a Waiver Application via the Health Commerce Site. • Via the Health Commerce Site practitioners for each site for which they will need a waiver will be expected to provide the following, according to BNE: – narrative explanation of the rationale for the – Article 33 license numbers and Official New York State Prescription (ONYSRx) form shipping address for each site seeking a waiver.
