  10. BZA# 2020-02 Sec. 30-97. - Accessory apartments. Accessory apartments, shall not be permitted as conditional uses in any of the residential zoning districts in the City of Florence. Accessory apartments, where permitted elsewhere as conditional uses, shall meet the following conditions: (5) Within the R-1 and R-2 zoning districts, an existing, detached accessory building may be utilized as an accessory apartment for an immediate family member as defined in this chapter who is in need of assisted living for a limited period of time. This requirement shall be fulfilled by the applicant in the form of a written affidavit for submittal to the board of zoning appeals for review of Zoning Ordinances and regulations. The building must meet all other development standards as required by this section and all applicable building codes. The above referenced portion of the Florence County Code of Ordinance expresses that should an accessory apartment legally exist, it should be heard by the Board of Zoning Appeals. There are inadvertently no other requirements pertaining to zoning regulations applicable to such a matter.
