FISHERIES ORDER, 2009 Interpretation “fish” means any aquatic animal or plant life, whether sedentary or not, and includes all species of fin fish, crustacean, molluscs, aquatic mammals or their eggs or spawn, fry, fingerling, spat or young, but does not include any species of otters, turtles or their eggs.
FISHERIES REGULATIONS, FISHERIES ORDER, 2009 Chapter 3 - No person shall, except under the terms and conditions of a valid licence - (a) Import into or export from Brunei Darussalam or have in transit in Brunei Darussalam any fish whether live or dead.
Department of Fisheries is the Competent Authority for exporting fisheries products from Brunei Darussalam to the global market by emphasizing the exporter to meet the requirements and standards of bio-security measures including safety, quality and any pre-requisites imposed by the authorities of the importing countries.

SUMMARY REQUIREMENT FOR IMPORT AND EXPORT OF FISH AND FISHERIES PRODUCTS FOR COMMERCIAL PURPOSES 1. Companies must be registered as importer and/or exporter of fish and fisheries products with the Department of Fisheries (one time registration); 2. Registered importer and/or exporter of fish and fisheries products should be registered as a user of Brunei Darussalam National Single Window (BDNSW) with the Royal Customs and Excise Department (one time registration); 3. Prior to the importation of fish (either frozen or live only), registered importers are required to provide a copy of valid Health Certificate and/or a copy of valid laboratory analysis issued by the Competent Authority from the exporting country to be submitted to Biosecurity and Export Certification Division, DOF for early import assessment; 4. Prior to the exportation of fish and fisheries products, registered exporters are required to apply Health Certificate to be issued by DOF according to the requirement of the importing countries; 5. Registered importer and/or exporter of fish and fisheries products should apply licence of import or export of fish and fisheries products through BDNSW (one application per consignment) including uploading supporting documentations such as Health Certificate etc. before import / export licence being issued by DOF.

PROCEDURE TO APPLY FOR IMPORT LICENCE OF FISH AND FISHERIES PRODUCTS IMPORT LICENCE FEE START $20.00 1. Registered importers submit the copy of Health Certificate and/or copy of laboratory analysis to Fisheries Biosecurity Division, DOF 2. Review / Check by Fisheries Officials not valid 3. HC / laboratory analysis valid ? 3a. Applicant to provide the valid valid HC / laboratory analysis 4. Registered importers submit import licence application with supporting documents through BDNSW 5. Review / Check by Fisheries Licensing Officer rejected 6. Application approve ? 1 working 6a. Applicant to reapply with approved day the required details and supporting documents 7. Registered importers received approved notification and pay the import licence fee online 8. Registered importers print the payment receipt and details of approved import licence via BDNSW END

Any person or company who is importing or exporting fish and/or fisheries products without a VALID LICENCE issued by the Department of Fisheries is guilty of an OFFENCE under Fisheries Order, 2009 and liable on conviction to a fine with the amount of B$10,000.00, imprisonment for a term of one (1) year or both.
