Environment and Climate Change Canada’s Presentation to the Wek’èezhìi Land and Water Board Regarding DDEC’s Proposed Misery Underground Water Licence Amendment WLWB Public Hearing Behchoko, NT Bradley Summerfield Meagan Tobin EPOD February 7-8, 2018
ECCC’s Mandate • Preserve and enhance the quality of the natural environment • Conserve Canada’s renewable resources • Conserve and protect Canada’s water resources • Forecast daily weather conditions and warnings • Enforce rules relating to boundary waters • Coordinate environmental policies and programs for the federal government Page 2 – 1er février 2018
How ECCC Fulfills its Mandate Relevant acts and regulations: • Department of the Environment Act • Canadian Environmental Protection Act • Fisheries Act – Pollution prevention provisions • Migratory Birds Convention Act • Species at Risk Act Page 3 – 1er février 2018
Recommendation 1 – Misery Underground (MUG) Nitrate Effluent Quality Prediction Update ECCC Recommends: • Nitrate concentrations in the water stored in the Misery pit should be monitored regularly during the filling of the pit and the modelling be updated to ensure that any high nitrate concentrations that may cause the effluent to be deleterious are identified early so that appropriate mitigation measures can be implemented. • DDEC should ensure that best management practices are used for nitrate source reduction for seepage from the Jay Waste Rock Storage Area. Recommendation 2 – MUG Phosphorus Effluent Quality Prediction Update ECCC Recommends: • Phosphorus concentrations in the water stored in the Misery pit should be monitored regularly during the filling of the pit and the modelling be updated to ensure effluent discharge does not alter the trophic status of Lac du Sauvage. • Total Phosphorus (TP) benchmarks should be established and monitoring of TP within the effluent plume area should take place (water quality and sediments) with contingency plans for mitigation if benchmarks are reached. Recommendation 3 – King Pond Settling Facility Discharge Quantity and Dilution Factor ECCC Recommends: • The quantity of water that will be discharged from the King Pond Settling Facility into the Cujo Lake annually during the Misery Underground Project should be confirmed. • The applicability of the dilution factor that was derived based on the Lynx amendment to the Misery Underground Project should be assessed.
