Legislative Requirements for Tourists – Proof of Payment and VAT Refunds to Tourists  Legislated that foreign tourists must declare proof of payment for cash sales exceeding R10 000 – bank statement / ATM receipt.  Submission made to SARS and National Treasury together with the Diamond Dealers Club of SA to increase the threshold to USD $10 000. Awaiting meeting date  VAT Refund pay-outs to tourists taking too long. JCSA to assist – contact at Tax Refund Office – track claims 5

Jewellery Council Risk Initiative  JCRI in operation for 7 years  Regular updates of crime incidents reported by jewellery stores - Consumer Goods Council.  JCSA and CGCSA – met with Council of Shopping Centres - attempt to improve safety and security in and around shopping centres.  Agreement reached that shopping centres implement a list of identified recommendations. Jewellers in the shopping centres will also be expected to implement a list of identified recommendations, depending on their size. This list was sent to members at the end of last 14 year. Follow up taking place now to measure

Consumer Protection Act - Indemnities and Disclaimers  Guidelines on Indemnities and Disclaimers drafted by JCSA Legal Counsel – circulated  CPA radically changed the way of conducting business, specifically to product liability and weighing up obligations on part of jeweller  Since inception of CPA strict liability applies and ANY party in the supply chain may be sued jointly and severally by a consumer for any harm  Some Salient Points that apply to jewellers: 17

Consumer Protection Act - Indemnities and Disclaimers  Return of Goods – 10 days for a full refund if sold through direct marketing or where consumer did not inspect goods  Any notice of a consumer agreement must be drawn to the consumer’s attention in simple, clear terms and verbal to an illiterate consumer.  One cannot divert liability to consumer in the event of gross negligence or recklessness, internal theft or fraud on the part of jeweller or staff  Warrantee on repaired goods is three months after repairs and does not apply to normal wear and tear. 18

  19. Consumer Protection Act - Indemnities and Disclaimers  Where a jeweller has possession of deposits, money or property belonging to consumer, jeweller must assume liability for any loss  When consumer fails to pay for or collect goods in possession of jeweller, consumer should be made aware BEFORE entering into a transaction that jeweller reserves the right to sell goods to defray costs  Due to strict liability in CPA, members should deal with all issues which may pose a risk to their operations through clearly displayed or printed indemnity and disclaimer provisions – seek expert legal counsel 19

The New Mining Charter  Letter to DMR Minister and met with the DMR Task Team for Growth and Competitiveness relating to the New Mining Charter  Proposal - establish Empowerment Fund  Requested Minister to consider reviewing framework of thresholds for applying Codes of Good Practice under Precious Metals Act  Current thresholds set out in the framework - 5kg and up or estimated maximum turnover is great than R3.8 million - seen as a medium and large business 21
