Draft Guidance Note • The Chief Social Worker, Adults, England was a member of an advisory group for a 3 year research project into social worker decision-making • She has asked that some guidance on the roles of social workers in applying the Care Act be drafted for her to consider • We are currently consulting on four Care Act roles we propose are appropriate to a social worker • The provision of social work • Difficult well-being judgements • Promoting protection from abuse and neglect • Safeguarding judgements • The draft will not address • Central or local government policy • The Mental Health Acts or the Mental Capacity Act

The Provision of Social Work • s8(c) identifies “counselling and other types of social work” as one way to meet needs • Counselling is listening and talking to help find ways of dealing with emotional issues which may act as barriers or risks to well-being • The Care Act is silent on the nature and purposes of the other types • Counselling is the only role in the Care Act which is definitely social work • If counselling is the identified way of meeting an eligible need, then it must be included in a care and support plan or support plan • If counselling is needed to help remove emotional barriers to promoting well- being : the assessment of that need should be carried out by a social worker • If counselling is included in a plan : the counselling should be carried out by a social worker

Difficult Well-Being Judgements • The well-being checklist in s1(3) of the Care Act provides indications for social worker involvement • Two relevant factors to which decision-makers must have particular regard are: • The importance of beginning with the assumption that the individual is best-placed to judge their well-being • The individual’s wishes (except that the Care Act disregards them in places) • Social worker involvement is indicated if • it appears that the individual’s judgement on their well-being would not be consistent with a properly made LA decision • following the individual’s wishes might not promote their well-being and especially if an adult is refusing an assessment or assistance

Promoting Protection From Abuse and Neglect • Abuse and neglect are violations of an individual’s lawful human and civil rights by any other person or persons • The Care Act recognises that protection from such actions is an element of well-being and stresses its importance in the well-being checklist • The needs assessment is the main legal vehicle for investigations into abuse or neglect • If an eligible need is having an impact on protection in any way, it must be met in such a way as to remove the impact and promote protection • The care and support plan or support plan is the means of promo�ng protection • A social worker should carry out the needs assessment: if it appears that needs may be having a significant impact on protection from abuse or neglect

  17. Safeguarding Judgements • The s42 safety net applies where: • There is reasonable cause to suspect that an adult is unable to protect themselves because of their care needs and is experiencing, or is at risk of, abuse or neglect • If their eligible needs are met as far as possible but the above are still the case • The LA must decide what should be done and by whom, in addition to any care and support plan it has been able to make • The LA must make only such enquiry as it thinks necessary to enable it to make this decision • The duty to take reasonable steps to stop the abuse is a HRA duty and may include the LA meeting ineligible needs or it may fall on another public authority (including registered care providers) • The judgement of whether there is reasonable cause to suspect the grounds are met for safeguarding enquiries should be made by a social worker • The decision on whether and what safeguarding enquiries are necessary and then what steps should be taken and by whom should be made by a social worker

  19. Social Worker Integrated Degree Apprenticeships What is an integrated degree apprenticeship?  An apprenticeship at level 6 upward  36 Month (3 year programme)  Includes the on-programme learning and end-point assessment in the same qualification

  20. What is a social work apprentice?  Not a student  In a paid role from day one  Learning on and off the job  Achieving the same professional recognition as a student

  21. How is their learning structured?  On-programme: 300 credits in around 30 months  End-Point Assessment: 60 credits in six months

  24. • The EPA must be conducted by an approved org from the Education & Skills Funding Agency’s (none approved to date) • Learning provider will be responsible for the on- programme learning & EPA End Point • Performance in the EPA will count towards the overall degree classification of Fail/3rd/2.2/2.1/1st Assessment . (EPA) Gateway requirements for the EPA • Complete 300 credits of the Social Work degree, • Been given a provisional grade • must have taken & achieved level 2 English and maths (equivalent to GCSE grades 9 to 4 or A* to C) and • Completed all on-programme learning requirements. • The EPA must be completed within a 6month period, after the apprentice has met the EPA gateway requirements. @AdultPSWNetwork
