Overview Presenter: Richard Liu > Renewable Energy Target (RET) emissions-intensive trade-exposed (EITE) companies can choose to apply as defined under the: > Renewable Energy (Electricity) Act 2000 (the Act), and > Renewable Energy (Electricity) Regulations 2001 (the Regulations). > Aims to provide 100 per cent exemption from RET liability for electricity used to conduct eligible EITE activities. RET EITE exemption certificate recipients must: 1. Conduct an eligible RET EITE activity (Schedule 6 of the Regulations). 2. Consume electricity that is liable under the RET. 3. Eligible EITE activities > Schedule 6 of the Regulations. > RET EITE Activity Boundaries document. > Some electricity is excluded from the amount of exemption in MWh. Am I eligible for exemption certificates? – 14 December 2018 5
Operation – section 31 of the Act > RET liable electricity consumed for the production of relevant products (EITE activity). > A RET liable entity is an individual or company who makes relevant acquisitions of electricity on a grid which has an installed capacity of 100 megawatts or more. > Non-liable electricity is not included for the purposes of the RET EITE activity. Prescribed Person > The applicant of the exemption certificate. > The Regulations describes five (5) prescribed persons: > 22G – person with contract for supply of electricity to site > 22H – liable entity with operational control > 22I – liable entity for future activity > 22J – person with a new contract for supply of electricity, and > 22K – nominated person. > These categories are differentiated between current and future activities and operational control scenarios. Regulations 22G – person with contract for supply of electricity to site To be eligible, immediately before the day the application is made you must be an entity with a contract for supply of electricity consumed by the RET EITE activity at the site with a liable entity. Regulations 22H – liable entity with operational control To be eligible, immediately before the day the application is made you must be a liable entity with operational control of the RET EITE activity at the site and in the 6 months preceding the application have: > Consumed more than 30% of the electricity for the site, or > The majority of the electricity consumed at the site be recognised as a RET relevant acquisition. Regulations 22I – liable entity for future activity Similar to regulation 22H, except the liable entity will have future operational control and operate the EITE facility during the application year. Am I eligible for exemption certificates? – 14 December 2018 10
Regulations 22J – person with a new contract for supply of electricity To be eligible, immediately before the day the application is made you must: > be an entity with the first contract for supply of electricity for electricity consumed during the year for the EITE activity at the site with a liable entity, and > cannot fall under prescribed person categories r.22G, r.22H and r.22I. Regulations 22K – nominated person > To be eligible, immediately before the day the application is made a prescribed person under r.22G, r.22H, r.22I or r.22J nominates another person for the EITE site and activity to be the prescribed person. > A prescribed person under r.22G, r.22H, r.22I and r.22J not apply.
