  2. State Regulatory Process and Status  Department of Environmental Quality  Authority: All sewerage systems and sewage treatment works shall be under the general supervision of the Board. The regulations of the Board shall govern the collection, conveyance, treatment, and disposal of sewage. Va. Code § 62.1-44.18  Process: Certificate to Construct Facility; Virginia Pollution Abatement Permit; Certificate to Operate Facility.  Status: Certificate to Construct – issued; Virginia Pollution Abatement Permit – Processing.

State Regulatory Process and Status  State Corporation Commission  Authority: Regulate formation, operation, financing, and rates of Public Utilities.  Process: Charter, Operations, Rates.  Corporate Charter issued for Public Service Corporation. Virginia Code § 13.1-620.  Obtained a Certificate of Public Convenience and Necessity authorizing it to furnish sewer service from State Corporation Commission. Virginia Code § 56- 265.3.  The application for such certificates shall include a comprehensive business plan detailing the technical, managerial, and financial resources to be devoted to operation of the . . . sewer service. Virginia Code § 56-265.3.1.  Status: Atlantic Town Center Utility Company, Inc. chartered as Public Service Corporation.
