2 BC Oil & Gas Commission - Overview • Established as a Crown Corporation in 1998 • Independent agency – report to a Board • Agent of the Crown – carry government’s responsibility for First Nations consultation • Single-Window Regulatory Agency for upstream oil & gas activities • Comprehensive role on major provincially regulated projects – issue almost all required permits except EA • Pure regulator of oil and gas activities – do not issue tenures or administer royalties • Do not set government policy or legislation

4 Federally (NEB) Regulated Projects – OGC Role • Large oil pipeline projects are federally regulated • Do not have primary jurisdiction – much more limited role than provincial projects • Authority for some specified provincial permitting – provided by Oil and Gas Activities Act regulation in 2012 – new and existing projects • No role with Enbridge Northern Gateway
Specified Enactments – NEB Projects Single-window Licence of Occupation Land Act Right-of-Way Lease Short Term Water Use Changes in & About a Stream Water Act Permits Over Crown Land Master Licence to Cut Forest Act Road Use Permit for FSR
6 OGC Consultation Approach – Trans Mtn • Intention to delegate procedural aspects of consultation to Trans Mountain • Involves obligations for Trans Mountain to engage, provide information, address concerns and report results to OGC • Coordination with the Major Project Management Office consultation processes and activities • Direct consultation by OGC – linked to results of Trans Mountain consultation • Engagement but no decisions on permits until after federal certificate issuance – exception for investigative permits
