Regulation 261/2004: The Follow-Up of Sturgeon Italian experience and Recent Development Impact of the Sturgeon Decision on the Italian experience  No significant impact.  Even before the Sturgeon Decision: Italian judges used to recognize passengers’ right to compensation in case of flight • delay of 3 hours, or less, and, in any case, to indemnify passengers for both pecuniary and so called moral damages arising from flight delay on the basis of the provisions set forth by the Montreal Convention (which, as known, provides for higher limits of air carrier’s liability) and/or on the basis of the general principles of law or equity provided by the Italian Civil Code and the Italian Navigation Code. No. 261/04 are compatible with the principle of proportionality;  Articles 5, 6 and 7 of (EC) Reg. No. 261/04 are compatible with the principle of legal certainty.
