European Union Consultation Paper on revisions to EU Directive, October 2010
Art. 9, 10 Guidelines Section 3.1.2.1 Regulating ingredients aimed at reducing tobacco product attractiveness can contribute to reducing the prevalence of tobacco use and dependence among new and continuing users. Section 3.1.2.2(i) Parties should regulate, by prohibiting or restricting, ingredients that may be used to increase palatability in tobacco products.
Art. 9, 10 Guidelines Guidelines - prohibiting additives: - colouring properties (some exceptions) - stimulants, eg caffeine, taurine - associated with health (eg vitamins, amino acids, fruits and vegetables)
US clove cigarettes • Indonesia filed WTO challenge to US ban on cigarettes with characterizing flavours, including cloves, but not menthol • Held flavours ban justified as a health measure • But exempting menthol but not cloves discriminated against Indonesia
Conclusion • Flavours increasingly appearing as a marketing strategy • Growing international regulation • Passes industry scream test • Further regulatory action needed and anticipated
