  3. What is a Charity Trustee? • In Ireland, a Charity Trustee, includes any officer of the body or any person for the time being performing the functions of an officer of the body. In Northern Ireland Charity Trustees means the persons having the general control and management of the administration of a Charity. • ‘Charity Trustees’ are defined in the Act and are essentially those persons having day to day control of a charitable organisation. • For charities with ‘management committees’ or ‘core groups’, the members of these groups will be considered to be ‘trustees’ as a result of this Act.

  4. Who can be a Charity Trustee? Persons aged 18 or over can be a Charity Trustee; but certain individuals are not entitled to be trustees under the legislation. Certain persons are disqualified from holding the position of Charity Trustee. In Ireland a person shall cease to hold the position of Charity Trustee if that person: • is adjudicated bankrupt • makes a composition or arrangement with creditors • is convicted of an offence on indictment • is sentenced to a term of imprisonment • is disqualified from acting as a director

  5. What are the duties of a Charity Trustee? Note: Some of the sections of the Charities Acts in both jurisdictions have yet to be commenced • That the Charitable Organisation/ Charity is on the Register of Charities Keep proper books of account which correctly record • The books of account must be kept for minimum of 6 years • To prepare an annual statement of account • If necessary arrange for the auditing of the books of account • Comply with any directions made by the CRA/CCNI with regard to the books of account • Prepare and submit to the CRA or the CCNI an annual report in a format which may be prescribed in respect of its activities after the end of each financial year

  6. Charity Trustee: Payment and Insurance • A charity is not, and will not be, permitted to pay trustees for their work in their capacity as a trustee (other than for receipted expenses). • A charity will be permitted to pay a Charity trustee (or persons connected to a trustee) for work which is not related to their role as a trustee. • Charities will be required to purchase ‘directors and officers’ insurance to indemnify its trustees for liabilities relating to acts done or omitted by the trustee in good faith and in performance of their functions as a charity trustee.

  7. Charities Regulatory Authority 16 October 2014: • Charities Regulatory Authority established • Charities Act commenced (except Part 4 – statutory investigations, and Part 7 – miscellaneous) • Register of Charities published • All existing CHY charities deemed registered – but additional information required • All other charities must apply to register by 16 April 2015 – extended to April 2016 • We are currently waiting for confirmation of a date from the CRA to bring Scout Groups in the ROI forward for registration • www.charitiesregulatoryauthority.ie
