PRIVACY OF STUDENT RECORDS • Protected by the Family Educational Rights and Privacy ACT (FERPA) • Rights of parent and student to review and confirm accuracy • Information collected by school on student can be released only for “specific and legally defined purposes.” • Applies to public schools, as well as federally assisted state and local educational agencies • Applies to third party records acting as agent of school
FERPA DEFINED EDUCATIONAL RECORDS • Student date of birth, SSN, ID#, picture and other personal information • Address of student/parent and contact information • Grades, scores, courses taken, awards, degrees and activities • Special education records • Disciplinary records • Attendance records • Medical and health records
ACCESS / RELEASE OF INFORMATION • School officials and teachers have access due to vested interest in student success • With prior consent of parent • Under limited conditions specified by law • As stated in the school’s student records policy, communicated annually to parents • In response to a subpoena or court order or others • To protect the health and safety of students
