  3. What’s New?  In October 2019, the most recent amendments to both the Comprehensive Developmental Disabilities (CDD) and Developmental Disabilities Adult Day (DDAD) Waivers were approved. These amendments updated service definitions, rates, performance measures, and other waiver expectations in response to plans of correction developed with the federal Center for Medicare and Medicaid Services (CMS).  The primary purpose of the new proposed amendments is to update the waiver eligibility criteria to include the populations which will become eligible for Medicaid under the Medicaid Expansion in October 2020 (Appendix B).  The new proposed amendments also include minor wording corrections to some performance measures.   4. Next Steps  Public comments will be accepted from May 1 to May 30, 2020.  Submitted comments will be reviewed and addressed by division staff. Comments and division responses will be included in the submitted amendments and posted on the DHHS Division of Developmental Disabilities (DHHS-DD) public website.  The amendment will be submitted no later than July 1, 2020, with a planned implementation date of October 1, 2020. This will coincide with the implementation of the Medicaid Expansion. Helping People Live Better Lives. 4

Introduction - Main  The Introduction/Main section of the waiver includes basic information about the waiver, such as a request for, purpose, and nature of the amendment; a brief description of the waiver; and a recap of the waiver application components.  The purpose and nature of the amendment were updated with a summary of the changes made in Appendices B and G.   6. Appendix B  Appendix B specifies the groups of Medicaid beneficiaries the waiver serves, amongst other eligibility criteria.  The waiver amendments add an additional specified group in Medicaid Eligibility Groups Served in the Waiver – adults age 19 and over without dependent children and with income at or below 138% of the Federal Poverty Level (Adult ACA Population) as provided in section 1902(a)(10)(A)(i)(VIII) of the Social Security Act and Section 42 CFR 435.119.   7. Appendix G  Performance measure A.3. was revised to reflect that a sample of reported incidents (high General Event Reports, or GERs) will be reviewed by DHHS-DD, rather than 100%.  Performance measure C.3. was revised to correct a typo in the description of the denominator.
